With the introduction and advancement of the “Belt and Road” initiative,capital exchanges between China and other countries have become more frequent.It provides unprecedented opportunities for creating a new type of multilateral cooperation mechanism and building a community with a shared future for mankind.However,since the “Belt and Road” initiative was put forward 8 years ago,the legal system adapted to the “Belt and Road”education service trade is still incomplete.Constructing a complete legal system is the institutional guarantee for promoting the “Belt and Road” educational exchanges and cooperation.This article mainly takes the “Belt and Road” as the starting point to analyze the defects of China's current education service trade legal system,through comparative research,we analyze the experiences of regions and developed countries where the world's education service trade is well developed,and put forward countermeasures and suggestions to improve the legal system based on the actual conditions of China and the “Belt and Road” region.This article mainly discusses from the following aspects:The first chapter elaborates on the basic concepts and the development status of regional education service trade,focusing on the perspective of China's education going global,and analyzes the relationship between the “Belt and Road” initiative and China's international education services;Chapter 2 is about the “Belt and Road” Under the background,the status quo and existing problems of my country's international education service trade legal system are explained.This is mainly reflected in the fact that the multilateral educational service trade mechanism has not yet been established,and the existing regional organizations have room to improve their role in the field of educational service trade due to their functional limitations in the exercise of power.In China,the main manifestations are loopholes,gaps,and partial conflicts at the legislative level.In addition,the main manifestations are the imperfections of the regulatory mechanism and dispute resolution mechanism;In the third chapter,the current regional education service trade legal system is analyzed horizontally in the European Union,the North American Free Trade Area and the Asia-Pacific region,and compared the legal systems of education service trade in the United States,the United Kingdom,Australia and other countries,so as to provide ideas for the countermeasures in Chapter 4.It is necessary to focus on the improvement of the legal system of education service trade in the “Belt and Road” region.On the one hand,it should actively formulate a multilateral mechanism for education service trade in the “Belt and Road” region that is in line with the majority of developing countries,at the same time,it should make full use of the existing legal mechanisms for international education service trade and international organizations;And through the improvement of domestic legislation,quality supervision mechanism and dispute settlement mechanism,reduce barriers to education service trade,Promote the in-depth and long-term development of cooperation,strengthen supervision in the development process,and improve the means of dispute settlement.
