Research On The Online Mediation Mechanism Of "smart Courts" From The Perspective Of Social Governance Modernization

With the modernization of social governance,the online mediation mechanism of China's "smart courts" is playing an increasingly important role in smart justice and multi-dispute resolution.Incorporating online mediation into the construction of intelligent justice is a useful attempt to improve intelligent justice and promote multiple dispute resolution.By integrating part-time social mediators,mediation organizations,invited mediators and mediation organizations into a unified management,it can meet the requirements of social governance modernization and enable social entities to participate in social governance.Under the traditional judicial-led model in the past,mediation,as one of the ways of dispute resolution,was not given enough attention.The overemphasis on dispute resolution through a single litigation model has led to a backlog of cases in grassroots courts,scattered court data and information,low efficiency in dispute resolution,and a lack of participation of multiple social governance actors.However,the application of big data and algorithmic rules in the online mediation mechanism of "smart courts" may make it difficult to guarantee the parties' right to information and defense,and may also threaten the security of network information.To this end,through the analysis of the jurisprudence of social governance modernization and the investigation of the operation mode of the online mediation mechanism of the "wisdom court",this paper proposes a plan to improve the docking of lawsuits and regulate the information security of big data and algorithm rules,in the hope of promoting the development of the online mediation mechanism of the "wisdom court".It is expected to promote the development of the online mediation mechanism of "smart court",so as to implement the goal of modernization of social governance.
