| A redundant marriage is a long existing marriage form in Chinese society,it is the supplement and variation of mainstream male and female marriage models.The germination of the matriarchal society,after thousands of years of historical baptism,continues to today,has a strong vitality.At present,the academic circle mostly studies plural marriage from the Angle of history.In fact,it is of great theoretical and practical significance to study the problem of matrimony from the perspective of legal history.By observing the marriage institution in ancient times and the research results in the academic circle today,it can be seen that the marriage and family institution has always been the focus of the legislature and experts and scholars.However,due to the lack of relevant historical materials and the difficulty of collecting and sorting,the academic circle has not achieved comprehensive and in-depth research results in this field,and for the matrimonial marriage outside the mainstream form,it is even weaker.However,plural marriage not only exists objectively in history,but also still exists today.At present,the number of only children in our country is very large,and our country is going from mild aging to moderate aging.The redundant marriage is appearing in our sight in a flexible way.The study of the ancient matrimonial system can not only make us more comprehensive understanding of the marriage and family relations in ancient society,but also help us to solve the marriage problem in contemporary society more perfect.Therefore,it is not only an academic issue,but also a practical one to discuss it.Compared with previous dynasties,the marriage in Song Dynasty has distinct characteristics.Before the Song Dynasty,You sou suffered discrimination and were often treated as untouchables.During the Song Dynasty,the marriage of redundant persons was more common than ever before.The attitude of the people and the government towards redundant persons had changed to some extent.The rights of redundant persons and the establishment of redundant persons marriage were protected and constrained by the law.At present,the academic research on the cause of the marriage in the Song Dynasty,the status of redundant husband and property rights is mainly,and the form content and entity content of the marriage system in the Song Dynasty and the influence of the marriage system on the later generations are less involved.Therefore,on the basis of sorting out and summarizing the previous research results,this paper will collect extensive data,and from the following parts to the Song Dynasty as far as possible to carry out a more detailed discussion of the marriage system:The first chapter introduces the development and evolution of plural marriage before the Song Dynasty and its prevalence.Since ancient times,the status of the son-in-law is very low.The prosperity and openness of the economy and culture in the Song Dynasty have made greater progress than in previous periods,and the degree of social tolerance has also been greatly improved.Many people no longer adhere to the so-called feudal ethics,and their attitude towards the son-in-law has changed to some extent,The second chapter discusses the establishment requirements,types and the dissolution of the marriage in Song Dynasty.The establishment requirements of a plural marriage in the Song Dynasty are divided into two parts:substantive requirements and formal requirements.The substantive requirements include marriage age and prohibitive conditions,while the formal requirements include marriage letter,betrothal and private contract.Marriage in the Song Dynasty can be divided into two categories:female and widow.The common circumstances of the dissolution of a plural marriage are:redundant husband does not work,improper conduct and the influence of national policies;The third chapter introduces the rights and obligations of the couple in the Song Dynasty.In Song Dynasty,the status of the son-in-law in his wife’s family clan is low,basically have no right to speak,so it focuses on the discussion of the property rights of the son-in-law.The wife’s rights are embodied in the management control of the family property and the dominant right to dissolve the marriage.The family obligations of both husband and wife are mainly embodied in:supporting parents,inheriting heirs,family work;The fourth chapter summarizes the influence brought by the system of redundant marriage in Song Dynasty and the enlightenment to the contemporary society.It is divided into the phenomenon of the plural marriage,the norms of the plural marriage wedding and the influence on the inheritance right of the superfluous son-in-law property as well as the reference significance to the problem of the plural marriage in contemporary society. |
