Xun Zi was the inheritor of Confucianism as well as the teacher of the legalist Han Feizi.Xun and Han were related to each other but each represented Confucianism and law.Taking the "concept of justice and interests" as the starting point,this paper analyzes the aspects of Xun and Han’s theory of human nature and the idea of governing the country,and probes into the similarities and differences of Xun and Han’s thoughts,so as to effectively analyze the similarities and differences of Confucianism and law philosophy.This paper is divided into four chapters.Based on the original text of Xunzi and Han Feizi,this paper compares their views on justice and interests in many aspects,in order to find out the similarities and differences of their views on justice and interests,so as to demonstrate the inheritance relationship between them.The first chapter is the historical background of the theory of justice and interests and the emergence of Xunzi and Han Fei.This paper briefly expounds the different meanings of righteousness and profit and traces the source of The Times when Xun and Han thought came into being.The second chapter is the analysis and comparison of Xun and Han on "righteousness",in which the basis and viewpoint of Xunzi’s "emphasizing righteousness" and Han Fei’s "abandoning righteousness" are demonstrated respectively,and the horizontal comparison of their moral and legal meanings is made,and the similarities and differences between them on "righteousness" are summarized.The third chapter is the analysis and comparison of Xun and Han on "profit",analyses Xunzi’s "profit by righteousness" and Han Fei’s "heavy profit" respectively,and analyses the different connotations of their human nature theory.The fourth chapter is the analysis and comparison of Xun and Han’s views on justice and interests,which respectively demonstrates the similarities and differences of their views on justice and interests,and analyzes and compares the common points and differences of their views on justice and interests from the perspectives of human nature,political philosophy and father-in-law’s rule of law,so as to draw the final conclusion. |
