Wang Fuzhi was a great philosopher of the late Ming and early Qing dynasties in China,as well as a famous thinker and historian of ancient times.Born in the turbulent Ming and Qing dynasties,Wang returned to his hometown to write books after hardships and hardships,and his writings,such as "On Reading the General Principles" and "On Song",are valuable spiritual treasures for future generations.The chaotic political background caused by the domineering eunuchs at the end of Ming Dynasty and the general background of the overthrow of Ming Dynasty and the entry of Qing army into the country made Wang Fuzhi start to seek the blueprint of the road to restore Ming Dynasty like other scholars.Although the people-oriented legal thought of Wang Fuzhi is different from the democratic thought that the people are the masters of the new era,the people-oriented factor in Wang Fuzhi’s legal thought can be regarded as the traditional source of democracy today,which can fill the gap of Wang Fuzhi’s legal thought from the perspective of the people and provide new thoughts for the construction of the rule of law in the new era.It can also provide new thoughts for the construction of the rule of law in the new era.As the legal thought of ancient thinkers is an important part of the excellent traditional culture of ancient China,the study,analysis and evaluation of Wang Fuzhi’s people-oriented legal thought can help us abandon the traditional rule of law culture in the new era.This paper takes the people-oriented factor in Wang Fuzhi’s thought as the main research content.As the three complementary dimensions of the rule of law in ancient times,the people-oriented feature is precisely integrated in the dimension of the sentiment and the law,so this paper studies Wang Fuzhi’s people-oriented legal thought from the perspective of human feelings,natural justice and national law in order to analyze the people-oriented factor in Wang Fuzhi’s legal thought more intuitively.The logic of this paper on Wang Fuzhi’s people-oriented legal thought is as follows,with four main parts.Firstly,it examines the general background of the formation of Wang Fuzhi’s people-oriented law,and elaborates on four aspects:politics,economy,culture,and changes of the times;secondly,it examines the theoretical basis that led to the formation of Wang Fuzhi’s legal thought,from Wang Fuzhi’s inheritance of the traditional people-oriented of Mencius and Xunzi to Wang Fuzhi’s influence of the theory of legal philosophy of the renewal of time;then,it takes Wang Fuzhi’s remaining work,"Readings of the General Principles" as the main object of study,and then refers to other Finally,the limitations and significance of Wang Fuzhi’s people-oriented legal thought are explored,and it is discussed that although Wang Fuzhi’s legal thought had limitations in his time,it had a profound influence on other thinkers in later times.Then,he evaluates the positive people-oriented elements in his thought,in order to realize a good match between the essence of his thought and the rule of law in the new era. |
