Wang Yun Legal Thinking

Yuan dynast was established by the Mongolian elite unprecedented in the history of the territory of a united feudal dynasty. With the progress of Economy Recovery and Product Development in the early Yuan, sprung up a number of Confucianism ministers, who offered many available proposals and suggestions for the country, and Wangyun is one of them. Research of Wangyun legal thoughts, has had a very important impact on the legal history of Yuan Dynasty and the actual application of the Yuan in the political and legal aspects.This article is based on Autumn Gorge 100 volumnes seeking Wangyun s legal thought from various historical literatures. First, with an eye to the political situation of the early Yuan Dynasty, starting from the political and economic background and ideological and theoretical basis at that time, it introduces the society condition and the background under which Wangyuns thought was born. Second, this article explores the causes of Wangyuns thought from his changes of duty and ideas and some important characters such as his ancestors and teachers. Third, it gives detailed content of Wangyuns legal thought from three aspects: legislation, economic law and judicial supervision. Among them, in legislation aspects ,Wangyun argued that "legislation was the beginning of administering a country, and then elaborates " set up imperial examination to collect talents "and" discussion with Bao Ju to check their duty "as a representative of administrative legislation thought; in Economic law aspects, taking money law and salt law as the research object, Wangyun analyzed deeply about the disadvantages of money law and put forward the method of feasible solutions, salt law discussed the basic sales of salt thought that "for profit, set offices to sale salt". In administrative supervision aspects, Wangyun proposed his supervisory thought about "Law strict and then the imperial lustration", this article states from three respects, and they are "attach importance to the suggestion", "law appropriate more heavier" and "rectify the social order and law". Finally, it concludes the core of Wangyuns legal thought and discusses its inference and inspiration to the modern construction of the law. This article also makes a brief evaluation about Wangyuns legal thoughts .The author affirms its legal thought the positive influence in the very beginning, and analyzes the limitations of his ideas.
