| Since the "One Belt And One Road" Initiative was put forward,international trade has become increasingly frequent.International multimodal transport is an important way of goods trade and transportation in countries along the route,and the documents of internationa l multimodal transport,which run through the whole process of transportation,are deeply related to the quality and efficiency of logistics.However,at present,intermodal transport documents are faced with many problems,such as complicated procedures for exchanging documents among different modes of transportation,lack of standardization and electronization,difficulties in settlement and financing of enterprise vouchers,and lack of sharing of documents information and data.These problems have brought difficulties to the settlement of disputes related to multimodal transport documents in financial,legal and commercial practice.Not only is it not conducive to improving the quality and efficiency of international multimodal transport,but it will affe ct the circulation of international multimodal transport documents and reduce the enthusiasm of countries along the "One Belt And One Road" Initiative to participate in international multimodal transport.However,the construction of the "ticket-unified system" rules of international multimodal transport can provide a feasible solution to the above problems.In this paper,the construction of " ticket-unified system " rules of international multimodal transport under the "One Belt And One Road" Initiative is the research object.Firstly,it analyzes the research trends of the "ticket-unified system" rules of international multimodal transport at home and abroad.It is found that there are some problems at present,such as the lack of unified "ticket-unified system" specific rules,the weakness of the connection between "ticket-unified system" and the "One Belt And One Road" Initiative era background,and the fragmentation of multimodal transport related rules research.Secondly,on this basis,the related concepts and basic theories of "ticket-unified system" of international multimodal transport are clarified by the method of hermeneutics.Through comparative study,this paper investigates the legislative modes and current situations of "ticket-unified system" in international multimodal transport between countries along the "One Belt And One Road" Initiative and China,and explores the judicial practices of " ticket-unified system" in countries along the "One Belt And One Road" Initiative by case analysis method combined with typical cases.Thirdly,through the above analysis,systematically sum up three kinds of problems existing in the practice of "ticket-unified system" of international multimodal transport under the "One Belt And One Road" Initiative: First,the application of the "ticket-unified system" law is not uniform,which is manifested by the disunity of national rules along the "One Belt And One Road" Initiative and the dispersion of multimodal transport legislation in China;Secondly,the legal functions of " ticket-unified system " documents are not perfect,it is characterized by the difficulty of electronic bill of lading circulation,the lack of financing function of transport documents and the ambiguity of evidence function of combined transport bill of lading;Thirdly,the informatization regulation of "ticket-unified system" documents is not perfect,which is manifested in the lack of unified regulation of document information content,insufficient legal protection of document information se curity and the absence of regulatory regulation on document information interaction.Finally,on the basis of a deep understanding of the existing problems,this paper gives the ideas of trying to construct the "ticket-unified system" rules of international multimodal transport under the "One Belt And One Road" Initiative: First,take the principles of equality and mutual benefit,fairness and efficiency and international cooperation as the basic principles to construct the " ticket-unified system " rules;Second,the coordination and unification of the legal rules of "ticket-unified system",the legal functions of "ticket-unified system" combined bill of lading and the convenience of "ticket-unified system" business practice are taken as the consideration factors in the construction of "ticket-unified system" rules;Third,this paper puts forward the realization paths of "ticket-unified system" rule construction of international multimodal transport under the "One Belt And One Road" Initiative,these are,formulating the "One Belt And One Road Regional Multimodal Transport Agreement",improving the legal functions of international multimodal transport bill of lading and promoting the standardization of "ticket-unified system" document information under the "One Belt And One Road" Initiative.It is expected that the construction of "ticket-unified system" rules for international multimodal transport can provide a solid legal basis for solving multimodal transport-related problems and promote the high-quality development of China’s international multimodal transport. |
