On The System Of Notarization Intervention In Personal Bankruptcy

With the rapid development of the socialist market economy,the enthusiasm of individuals to paricipate in economic activities is soaring.On the one hand,the market has brought many opportunities and rich returns to individuals.On the other hand,due to insufficient market understanding and information asymmetry,many people also face Bankruptcy dilemma.In response to this situation,the establishment of a personal bankruptcy system is imminent.In the process of exploring the personal bankruptcy system in our country,the system design that has received much attention focuses on the scope of application of personal bankruptcy,free property,and exemption from liability,but few people use the notarization system to intervene in personal bankruptcy affairs.Based on the observation of relevant systems outside the territory and combining with the current legislative status of our country,the author believes that the establishment and perfection of our country’s personal bankruptcy system presents a need for notarization interv ention.Therefore,this article is mainly divided into four parts.The first part is an overview of our country’s personal bankruptcy system,which mainly analyzes the necessity of establishing a personal bankruptcy system and the main problems faced by the establishment of a personal bankruptcy system;The analysis of the necessity of the system firstly establishes that notarization has the meaning of breaking the question for the establishment of a personal bankruptcy system.Secondly,it analyzes the significance of notarization intervention in solving the dilemma of "more cases and fewer people".Finally,it is necessary for notarization to intervene in personal bankruptcy from the perspective of social governance.The third part is to demonstrate by introducing the value orientation of the personal bankruptcy system and the notarization system,the continuous expansion of the field of China’s notarization,the active practice of foreign notaries’ intervention in personal bankruptcy,and summarizing the advantages of China’s own notarization system.The feasibility of notarization intervention in the personal bankruptcy system;the last part is some legislative suggestions for the construction of the personal bankruptcy notarization intervention system,mainly starting from the personal bankruptcy legislation and the adjustment of the "Notarization Law",through the legislative form to clarify the involvement of notarization in personal bankruptcy,with a view to While promoting the development of the notarization system,it is helpful to the establishment and improvement of China’s personal bankruptcy system.
