On The Legal Rules Of China’s Green Industry Fund

In order to promote the high-quality development of the country’s social economy,the Fifth Plenary Session of the 18^th Central Committee of the Communist Party of China put forward the concept of green.China proposed to develop green finance in 2016 and set up green industry funds as a financial tool to support the transformation of the economy to green.Subsequently,regional governments set up green industry funds one after another to guide all kinds of social capital to invest in the environmental protection industry,so as to effectively solve the dilemma of green industry due to difficult and expensive financing.As one of the important investment fields of government industrial guidance funds,the green industry has become the backbone of green investment in the equity market.Due to the lack of corresponding prefect laws and regulations,the green industry fund has not been effective in the actual operation process,with the unclear positioning of government roles,the limited funds raised,the inconsistent fund objectives,and the imperfect fund management organization system.As a result,the green industry fund deviated from the right path and failed to give full play to the function of guiding the fund to leverage capital and optimizing resource allocation.Therefore,by combining the objective actual situation of our country,this thesis focuses on the problems existing in the actual operation of green industry funds,so as to provide feasible suggestions for improving the legal regulation of green industry funds in our country.The thesis is divided into introduction,body（four chapters in total）and conclusions.The introduction introduces the research background,research purpose,practical and theoretical significance,literature review,research methods,innovation and deficiency of this thesis;The first chapter of the main body defines the concept of this thesis,including the positioning and of the green industry funds,defines the scope of the main objects studied in this thesis,and analyzes the necessity of improving the legal adjustment of the green industry fund from the theoretical and practical levels.The second chapter analyzes the development status of China’s green industry funds from the legislation and practical levels to summarize the existence of green industry funds in the practical operation process,and further clarify the main problems to be solved in the thesis:the unclear role of the government,the limited funds raised,the inconsistent fund objectives,and the imperfect fund management organization system;Chapter three to chapter four summarize the experience and lessons of green industry fund in management mechanism,organization form and system construction from domestic and foreign dimensions,so as to provide suggestions for the following to improve the system construction of China’s green industry fund operation:first,clarify the role of the government in the establishment of green industry fund operation,which should be more biased towards supervision,We should not interfere too much in the operation process of the fund,and the regulatory body should be clear to prevent moral hazard;Second,diversify the funds raised and establish a perfect incentive mechanism;Third,the establishment of goals should be scientific and coordinate the target interests with other capital subjects;Fourth,the organizational structure of management adopts the form of limited partnership,which can reduce the operational risk and is also in line with the future development direction.The conclusion and prospect part of the thesis summarizes the main conclusions of the full thesis again according to the above research content,so as to improve the construction of green industry fund operation system.
