Research On The Predicament And Countermeasures Of The Investigation Of Cyber Drug Crime In China

In recent years,the number of new drug crime cases integrated with the Internet has surged,and the trend of anonymization of crime platforms and diversification of drug types is obvious.In order to effectively combat such crimes,it is necessary to start from the behavior pattern of network drug crimes,and to provide reasonable countermeasures one by one for the detection loopholes existing in each link of the criminal behavior.Internet drug crime spans two real and virtual spaces,with the basic model of online release of drug-related information-online drug-related content consultation-online payment of drug money-online delivery and delivery.In the investigation of such crimes,in theory,it is necessary to integrate network investigation elements on the traditional basis,to discover drug-related cases through online platform supervision,analyze drug-related network traces to determine the identity and whereabouts of suspects,and use network investigation methods to obtain drug-related electronic data.However,after analyzing 600 judgment documents of online drug crimes,a typical case of the Ministry of Public Security,and reading related documents,it is found that there are weak network platform control,lagging laws and regulations,and ability to respond to anti-investigation behaviors in the investigation of online drug crimes in my country.Insufficient,low efficiency of electronic data forensics,and the related systems behind the problem are not perfect,technical means are not advanced enough,and departmental coordination is not enough.Fully learning from the excellent foreign experience and examining the domestic excellent practice can provide useful inspiration for the improvement of my country’s network drug crime investigation capability.The emergence of cyber-drug crimes in the United States and Europe was earlier than that in my country.Through the review of relevant literature,it was found that the two places were more complete in terms of investigation intelligence and investigation techniques for cyber-drug crimes.Some regions in my country have also carried out efficient innovations in the construction of cyber-drug crime investigation teams,technology application research and development,etc.After in-depth exploration of theory and practice,in response to the problems existing in the investigation of online drug crimes,it is necessary to strengthen the position control of online and offline links,improve the legislation of case filing jurisdiction and drug control,innovate scientific investigation technology,and promote the information exchange platform and large scale.Measures such as building a data analysis platform and strengthening electronic data forensics capabilities to solve the problem.
