Research On Legal Issues Of Sino-Russian Energy Cooperatio

Currently,energy is a necessity for economic development,and the stability of energy supply is related to the progress of society.The rapid economic development makes China’s dependence on energy increase year by year.International cooperation on energy has become the mainstream cooperation mode of the international community.Russia,as a close neighbor of China,also has the title of a major energy exporting country.Against the background of economic sanctions imposed on Russia by Western countries,energy cooperation between Russia and China has a huge prospective.Therefore,strengthening the energy cooperation between Russia and China is a feasible way to meet the background of the times,which not only brings impetus to Russia’s economic development,but also ensures China’s energy security.This paper is an in-depth exploration of energy cooperation between the two countries from a legal perspective,and I have designed this paper into six parts.The first part is the introduction.In this part,the author introduces the background and significance of the study and the research methodology and innovation points of this paper.The second part is the theory of China-Russian energy cooperation.By defining the content of China-Russian energy cooperation,this paper puts forward the evolution and current situation of China-Russian cooperation in the field of oil and gas.At the same time,it discusses the basic principles that China Russia energy cooperation should follow,and makes a legal analysis on this basis.This is the theoretical basis of China-Russian energy cooperation.The third part is the legal basis of China-Russian energy cooperation.This part mainly introduces the realistic basis of China-Russian energy cooperation and composes it from two perspectives,introducing the domestic legal basis and international legal basis of the two countries concerning energy respectively.The fourth part is divided into legal problems of China-Russian energy cooperation.By sorting out the legal basis of the previous part,four corresponding legal problems are proposed,which are the problems existing in the domestic laws of the two countries,the problems existing in the legal basis of bilateral energy cooperation between the two countries,the problems existing in the dispute settlement mechanism and the problems existing in the China-Russian energy cooperation under the multilateral legal mechanism.The fifth part is the international practice and inspiration of energy cooperation.The author analyzes the issues raised in the previous section,draws on the bilateral and multilateral dimensions and summarizes the inspirations for the energy cooperation between China and Russia to prepare the ground for the next section.The sixth part is the improvement of the legal issues of energy cooperation between China and Russia.Firstly,we will improve the domestic laws of China.Second,to improve the legal basis of bilateral energy cooperation,this paper envisages that the two countries will sign a basic agreement with clear rights and obligations and compulsory binding,and on this basis,conclude an agreement on transnational energy transportation pipeline with clear jurisdiction and guarantee the safety of energy transportation.Again,to improve the dispute settlement mechanism,this paper envisages the construction of a multi-level and multi-dimensional dispute settlement mechanism,which can resolve disputes in various ways.Finally,strengthen China and Russia energy cooperation under multilateral legal mechanisms.Under the global multilateral legal mechanism,the two countries should actively join the global energy organization.Under the regional multilateral legal mechanism,build an energy club for the Shanghai Cooperation Organization to strengthen China and Russia energy cooperation.
