In recent years,the development of science and technology has begun to gradually affect all aspects of our lives,many fields,especially the development of intelligent technology is changing our work and lifestyle,and has also had a strong impact on the administrative field.At present,the application of artificial intelligence technology in the field of administrative punishment in China has been common,such as the application of intelligent equipment such as electronic monitoring equipment and electronic sonar equipment,and these intelligent law enforcement methods can be called automation methods.The application of automated methods has made administrative punishment procedures more standardized,the objectivity and fairness of administrative punishment decisions improved,and the efficiency of administrative punishment law enforcement improved.Through the analysis of cases,the author found that the application of automation has also brought some new problems to administrative punishment,such as the improvement of punishment efficiency will lead to an imbalance in the density of punishment,the excessive dependence of administrative law enforcement personnel on automation methods leads to the weakening of administrative personnel’s ability to enforce,the challenge of automation methods to the principle of due process,and the black box and bias of algorithms may lead to errors and unfairness in penalty decisions.In order to better use automation in the field of administrative punishment,these problems should be solved through legal control.This paper takes how to legally control automated administrative penalties as the research object,and mainly studies from the three aspects of legislative control,procedure control,and result control,and tries to improve the legal problems faced by automated administrative penalties.
