| With the rapid development of modern science and technology,the application of relevant technologies can be seen everywhere in administrative activities,which also highlights the advent of the era of automated administration.Compared with traditional administrative punishment,automatic administrative punishment uses automatic monitoring system,automatic punishment system and other intelligent equipment,with the help of modern technology means to make the punishment more efficient,more accurate,the punishment result is more fair.But at the same time,automatic administrative punishment also has some new problems,such as limited scope of application,the relative procedural rights lack of protection,the existence of the above problems indicate that automatic administrative punishment needs regulation.In this paper,legal regulation is taken as the way to control automatic administrative punishment.By combing the existing legal regulation means of automatic administrative punishment,it is found that the current legal regulation for automatic administrative punishment is not perfect,and there are problems in the application scope,system setting,procedure implementation,information disclosure and result supervision.In order to ensure the legalization and standardized operation of automated administrative punishment,this paper puts forward suggestions to improve the legal regulation of automated administrative punishment based on the above problems.It clarifies the scope of application of automatic administrative punishment by improving legal provisions,controls the automatic administrative system by standardizing the setting system,and ensures procedural legitimacy in automatic administrative punishment by refining and implementing relevant procedures.By improving information disclosure to supervise the situation of automatic administrative system participating in punishment and by strengthening the result supervision to force administrative organs to standardize the implementation of automatic administrative punishment. |
