Research On The Issue Of Live Broadcast Of Law Enforcement By Administrative Agencie

The value of live broadcasting law enforcement by administrative organs lies in forcing the standardization of law enforcement with open procedures and realizing legal education with live broadcasting.But at the same time,there are also many problems: some are manifested in the infringement of citizens’ personal rights and interests,such as the infringement of the right to reputation and privacy;Some are manifested in the dilemma of the exercise of citizens’ right of resistance,such as theoretical dilemma and practical dilemma;Some show the problem of selective live broadcast law enforcement,such as choosing the time and object of live broadcast law enforcement.The existence of these problems makes the author deeply feel the importance and urgency of studying this topic.The article is divided into the following four parts:The first part is the theoretical overview of the live broadcast law enforcement of administrative organs,which is the theoretical basis for the follow-up analysis and elaboration of the live broadcast law enforcement of administrative organs.It mainly expounds the off-site law enforcement,the whole process recording system of administrative law enforcement and other related concepts,analyzes the characteristics of the live broadcast law enforcement of administrative organs,such as timeliness and professionalism,points out the general principles that should be observed,such as the humanized law enforcement principle and the proportion principle,and puts forward the requirements that should be followed,such as the objective and true content and the protection of privacy.The second part is about the current situation of the law enforcement by the administrative organs and the necessity of standardization.This part points out the application scope of live broadcast law enforcement by administrative organs,that is,it is generally used in urban social management law enforcement and people’s livelihood law enforcement,such as investigating and dealing with drunk driving and recording traffic warning live broadcast law enforcement programs.The analysis of the necessity of standardization includes the internal requirements of the construction of a government ruled by law and the serious consequences of non-standard live broadcast law enforcemen.The third part is the analysis of the problems existing in the live broadcast law enforcement of administrative organs.This part discusses from four aspects: infringement of citizens’ personality rights and interests,the right to resistance,selective live broadcasting law enforcement,and the balance of rights and interests.As far as the personal rights and interests infringed by the live broadcast law enforcement of administrative organs are concerned,this paper mainly discusses the performance and harm of infringing upon citizens’ privacy and reputation rights;As far as the right of resistance is concerned,it mainly analyzes the value and dilemma of citizens’ exercising the right of resistance in the process of law enforcement by administrative organs,and reveals the necessity of ensuring citizens’ exercising the right of resistance;In terms of selective live broadcasting law enforcement,it mainly discusses the concept,performance,reasons and other aspects,pointing out the direction for the improvement suggestions of the following text.The fourth part,the research on the Countermeasures of the law enforcement of the live broadcast of administrative organs,mainly expounds how to solve the existing problems,promote the benign development of the law enforcement of the live broadcast of administrative organs,and protect the legitimate rights and interests of citizens.It mainly includes four aspects of optimization measures: first,in view of the infringement of citizens’ personality rights and interests,it puts forward suggestions such as multi-party joint efforts to safeguard rights,the combination of prevention and relief,and the use of technical means to protect citizens’ privacy.Second,in view of the difficulties in the exercise of citizens’ right of resistance,such as the absence of theory,the absence of procedure,the exercise risk and so on,it puts forward some suggestions,such as refining the rules and procedures,clarifying the exercise conditions,adhering to the exercise principles and so on.Thirdly,in view of the problem of selective live broadcasting law enforcement,it puts forward some suggestions,such as strengthening internal regulations,standardizing live broadcasting law enforcement procedures,strengthening supervision and power restriction.Fourth,the live broadcast law enforcement staff were specially proposed to improve the quality of personnel,establish and improve the strict accountability system and other suggestions,so as to standardize the live broadcast law enforcement behavior of administrative organs.
