An Ecological Research On The Phenomenon Of Legal Profession Conversion In Our Country

In the new era,China’s economic and social relations have become increasingly complicated,contradictions and disputes have become prominent,the people’s awareness of rights protection has been enhanced,and the cases accepted by the people’s courts have gradually increased,resulting in the phenomenon of "litigation blowout".At the same time,the reform of the judge post system,as the core strategy of promoting the professional construction of judges,has impacted the original interest arrangement.This new social situation requires not only to optimize the overall operation process of the rule of law,but also to improve the formation mechanism of legal professional subject and the disposition of judicial human resources.In this context,it is easy for judges to "go to sea" and become lawyers in large numbers,while it is difficult for lawyers to "go ashore" and become judges in small numbers.It is an obvious fact that China’s legal resources are unbalanced and scarce.The imbalance between supply and demand of legal resources stimulates the reform of legal professional organization system.Under the existing social system,it has become the key content of the construction of the rule of law to seek an efficient "intensive" allocation of legal resources and take a road of judicial professionalization in accordance with the national conditions.This article will draw lessons from existing research results,attempt with the ecological theories of sociology of law,legal professionals as the core,put legal professional conversion system in macro to micro system,economy,culture and social environmental factors,focus on their professional boundaries in the social environmental factors under the action of processing and resource substitution of social process,It also studies the social and ecological impact brought by their decision of career change and puts forward theoretical ideas for the further reform of the relevant judicial system.It is found that there is a powerful integration process behind the complex phenomenon of career transition,that is,the interaction between the market and the state.At the same time,in the unique ecological environment,the phenomenon of legal occupation conversion in China presents obvious and profound particularity.For the construction and improvement of the legal profession conversion mechanism,it is necessary to take the deep local legal resources and values as the basis,overall consideration of macro and micro social ecological factors and balance constraints,and at the same time carry out a scientific analysis outside the region.We should prevent the two extremes in the legal profession conversion system.On the one hand,we should not eliminate the subjective initiative of the reformers to build a beautiful ecological blueprint for the legal profession conversion;on the other hand,we should stick to the principles of the ecological theory which are objective,reasonable and in line with the requirements of the development of the legal system in China.We should pool our wisdom and base ourselves on the long-term,find a balance path that is most beneficial to our country from the ecological contradiction,and implement it step by step with key points.
