| On March 1,2011,the rules on educational punishment for primary and secondary schools(trial)came into force,educational punishment for primary and secondary school teachers has become a key research content in educational law circles.In order to standardize the exercise of teachers’ educational punishment,protect students’ legitimate rights,promote the high-quality development of primary and secondary education.Teacher education discipline in urgent need of empowerment and limited,therefore,in this thesis,the primary and secondary school teachers education disciplinary further refinement,for teachers education disciplinary “abuse” and “idle” status.The basic idea of this thesis is based on the rules,starting from the analysis of the legal attributes and basis of teachers’ educational punishment power in primary and secondary schools,expounds the justification basis of teacher education punishment,analyzes the existing problems of teacher education punishment,focuses on in-depth exploration of the legal system of teacher education punishment,finally puts forward suggestions for improving the legal regulation of teacher education punishment behavior.In particular,the scope of application,implementation and supervision and relief mechanism of teacher educational punishment.The main content of the article consists of the following four parts.The first chapter is the introduction part,mainly involves the following content: the selected topic background,research significance,literature review,research methods and innovations.The second chapter for teacher education disciplinary legitimacy and legal attributes.As for the legal attribute of teachers’ power of educational punishment,this thesis analyzes the difference between right and power,the source of teachers’ power of educational punishment and the design of legal system from the basis of legal theory,and concludes that teachers’ power of educational punishment belongs to the nature of power.The third chapter analyzes the deficiencies of the rules on teacher education punishment from the current practice of primary and secondary school teachers.The fourth chapter puts forward the improvement of the teacher education disciplinary laws regulating suggestions,in the teacher education punishment power belong to the category of power,while giving its power,to limit its power more.It is particularly important to protect students’ legal rights.Therefore,suggestions are put forward to improve the implementation subject,method,scope and supervision and relief of teachers’ educational punishment.Of teacher education discipline behavior regulation is the inevitable requirement of teaching in accordance with the law,it is not only the teacher empowerment education and punishment,but also provide the basis for teacher education disciplinary regulations to exercise,and provide a strong guarantee to the legitimate rights for the students. |
