Research On Judicial Review Of Invalid Administrative Action

With the revision of the Administrative Procedure Law and the promulgation of the Application Interpretation in 2018,the judicial review of invalid administrative acts has been further developed.Since confirming invalid judgment is an important part of administrative litigation judgment,it is of great significance to construct a scientific and complete invalid administrative action litigation system.However,there are still many problems to be solved in the legitimacy of the establishment of the judicial review system of invalid administrative acts in China.For this reason,this paper needs to clarify the connotation of invalid administrative behavior,and the logical analysis of the relevant theory,confirm the legitimacy of the establishment of invalid judgment,and then through the experience of the review,and then to the invalid administrative act judicial review of prosecution period,proof rules,to follow the principle of consistent and entity identified problems,thus to improve the judicial review system of invalid administrative behavior in theory and practice.
