Research On Legal Issues Of Cross-border Data Flow Governanc

After entering the era of digital economy,the rapid development of digital technology and the deep combination of globalization make cross-border data flow show a trend of scale and complexity.At the same time,data security,data sovereignty,data hegemony,data localization and other global problems occur frequently,seriously affecting the efficiency of data flow and data value conversion,which requires international actors to conduct global governance and cooperation.Therefore,based on the current situation,it is becoming an urgent research topic to clarify the conceptual connotation and practical impact of cross-border data flow,clarify the current practical predicament,so as to explore a more effective and balanced global cross-border data governance scheme and form a safe and free cross-border data flow order.Therefore,this paper studies the global governance framework of cross-border data flow by analyzing the data protection regulatory documents and data development strategy practices of major countries,and discusses the current situation and dilemma of cross-border data flow governance in detail.In the first part of the paper,the concept of cross-border data flow is defined based on a brief review of its development,and the necessity of global data governance is emphasized.In the second part,based on the current governance reality of cross-border data flow,representative data governance rules of major countries are selected to systematically sort out the governance status of cross-border data flow,and it is proposed that the current governance system has the characteristics of rule game and interest cooperation.The third part discusses the dilemma of cross-border data flow and further clarifies the problems and difficulties in the management of cross-border data flow.The fourth part puts forward feasible plans for global data governance,proposes to construct an international rules framework for effective governance of cross-border data flows from the perspective of global governance,and proposes China’s plan for future global data governance from the perspective of China.
