Research On The Evaluation Index Of "Case/item Ratio" In Criminal Cases

In the context of the new era,the concept of procuratorial work has also been transformed into providing bidirectional procuratorial products with a sense of "service".Its connotation is to pay more attention to the people’s yearning for a better legal life on the basis of paying attention to the quality of procuratorial work case handling.Case quality is the lifeline of procuratorial case handling work,and the "case/item ratio" evaluation index is a core component of the case quality evaluation index system proposed by the Supreme People’s Procuratorate,fully demonstrating the concept of justice for the people and directly reflecting the quality and efficiency of procuratorial organs in handling criminal cases.Since 2020,China’s procuratorial organs at all levels have effectively improved the quality and efficiency of criminal prosecution cases by using the "case/item ratio" evaluation index.However,from a practical perspective,the indicator values in some regions are still high and have not met expectations.In addition,there are also some procuratorial organs that consider the "case/item ratio" evaluation indicator as an efficiency indicator and do not comprehensively consider improving the quality and efficiency of cases,blindly pursuing a lower value of the "case/item ratio" evaluation indicator,which has affected the development of procuratorial work.Therefore,this article deeply discusses and examines the specific application of the "case/item ratio" evaluation index in judicial practice,analyzes and summarizes the subjective and objective factors that affect the "case/item ratio" evaluation index in criminal cases,and finally proposes corresponding content optimization and reasonable application suggestions.The article is divided into four parts:The first part of the paper is an overview of the evaluation indicators for "case/item ratio".Clarify the basic connotation of the "case/item ratio" evaluation index,analyze the theoretical value orientation of the "case/item ratio" evaluation index from the perspectives of procedural litigation value requirements,procuratorial power supervision and restraint,punishment of crimes,and protection of human rights,and deeply analyze the role and significance of the "case/item ratio" evaluation index in promoting the high-quality development of procuratorial work.The second part of the paper examines the operation of the "case/item ratio" evaluation index from a practical perspective.It analyzes and summarizes the specific application status of the "case/item ratio" evaluation index in judicial practice from the perspectives of criminal charges,case structure,and abnormal "cases",and summarizes the problems in the operation process of the"case/item ratio" evaluation index.The third part of the paper explores the impact of different factors on the"case/item ratio" of criminal cases from both subjective and objective perspectives.The type,structure,and quantity of cases accepted by procuratorial organs will directly affect the evaluation index of "case/item ratio";At the same time,factors such as the ideological concepts,ability levels,and management methods of procuratorial staff have a subjective impact on the evaluation index of "case/item ratio".The fourth part of the paper provides suggestions for optimizing the evaluation indicators of the "case/item ratio" of criminal cases and their operation.On the basis of improving the content design of the "case/item ratio" evaluation index itself,effective measures are proposed to optimize the operation of the "case/item ratio" in criminal cases,including strengthening the implementation of leading responsibilities from the perspective of procuratorial work,and strictly controlling the occurrence of the "three delays and two withdrawals" procedure;Deeply implement the separation of complex and simplified cases,improve the work ability of prosecutors,and work together to reduce criminal cases...
