| The Arctic region is one of the most fragile ecosystems in the world.Due to its unique geographical location and climatic conditions,the ecological environment is more susceptible to external factors.The marine environment in the Arctic region also has higher acoustic reflection and refraction characteristics,making marine noise pollution easier to be amplified and propagated.Arctic marine organisms are highly dependent on sound,which makes the impact of Arctic marine noise pollution on the entire ecosystem chain,and noise will interfere with and destroy the entire food chain.With the impact of global climate change,glaciers and sea ice in the Arctic region are gradually melting,resulting in the increasingly convenient opening of the Arctic waterway,a large increase in human activities in the Arctic region,and an increase in Arctic marine noise pollution.Based on the theory of regional governance of Arctic waters and global governance of the law of the sea,this paper studies the relevant issues of legal governance of Arctic marine noise pollution.This paper mainly analyzes the related concepts,sources and effects of marine noise pollution,and puts forward the reasons why it is necessary to control the particularity of the Arctic natural environment.It sorts out the environmental theoretical basis of legal governance such as the principle of environmental prevention and the principle of protecting and preserving the marine environment,and sorts out the global and regional international legislation of Arctic marine noise pollution.At the same time,it sorts out the current situation of legal regulation in the United States,Canada,the European Union and other regions and countries,and accumulates existing experience by combing existing legal norms.It also analyzes the regulation of marine noise pollution by international organizations such as the International Maritime Organization and the Arctic Council,and finds out the defects of existing legal documents.The existing problems of relevant regulations mainly include three aspects:imperfect basic theory of marine noise pollution,insufficient cooperation among Arctic governance subjects,and lack of effective international legal documents.Based on the existing legal regulations of various organizations,countries and regions,the concept of Arctic marine noise pollution is proposed,and the noise pollution control standards are completed in collaboration to define Arctic marine noise pollution.Promote the diversification of communication methods for governing countries,and strengthen cooperation among governance entities in the Arctic region with the Arctic Council as the center;develop technical standards for marine noise in related activities,control the speed of Arctic ships,establish a list of marine noise pollution restrictions in the Arctic region,and establish dynamic and coordinated legal rules for noise pollution control to improve the Arctic marine noise pollution legal documents.Targeted solutions to the problem of Arctic marine noise pollution are proposed,and suggestions are put forward for China to participate in Arctic governance and actively solve the problem of Arctic marine noise pollution,such as clarifying the concept of prevention and control,guiding the shipbuilding and operation industry to reduce noise emissions,strengthening scientific research on Arctic marine noise,and promoting the establishment of soft law on Arctic marine noise pollution. |
