Research On Copyright Infringement Of Short Video In China

Short video with rich content and can make full use of fragmentation characteristics such as time,people more and more popular among people,but because of the large flow behind the short video and commercial value,moral and even lead to a lot of people against violations of law to infringement of copyright in works of others,thereby on the basis of the damage the interests of others to make their own profit,but also easily causes an unhealthy industry development environment.Therefore,it is very important to protect the copyright of short video,and the premise of protecting the copyright of short video is to analyze the problem of short video infringement.The copyright infringement of short video becomes more and more serious with the increase of the popularity of short video.The relevant laws in China are also constantly improving and developing,but there are still three controversial issues in practice: the judgment of short video originality;The application of the principle of fair use;Short video platform of liability problem,so it requires a combination of domestic classic case to analyze problems,respectively from the foreign relevant experience on short video infringement of the above three problems,finally based on three main problems that exist in the short video copyright infringement improving Suggestions combined with outside experience.In view of the chaotic situation of infringement in the short video industry,and in order to better determine the infringement and governance of the infringement phenomenon,this paper proposes a clear identification standard of short video originality,such as refining the standard of "creativity",such as adding the identification standard of transformational use,clearly quoting the degree of "quality" and "quantity",and judging the influence of use based on the purpose of use;Standardize the responsibilities of short video platforms,such as improving the "haven" principle,enhancing the review obligation of short video platforms,and building a diversified platform management system.The infringement of short video should be regulated from all aspects,and a healthy environment should be created for the development of short video through the efforts of all parties.Figure 0;Table 1;Reference 50...
