Research On Criminal Regulations Of Child Pornography

Child pornographic information is very harmful to children and society.However,through analysis of the current situation of child pornography in my country’s legislation,it is found that my country’s non-criminal laws governing child pornography have obvious deficiencies,such as fewer legal documents,insufficient legal levels,and lower penalties.The original crimes of obscene products in the Criminal Law regulate child pornography,but there are also problems such as the clear determination standard that there is no child pornography,the small crackdown on child pornography-related behaviors,and the small difference in penalties for adult obscene information crimes.Therefore,the criminal law sets up special The regulation of child pornography by law is imminent.To study child pornography crimes,on the one hand,we need to start from the source and study the reasons why children become victims of child pornography;on the other hand,we need to analyze the flaw of my country’s criminal laws on regulating child pornography based on the current legislation and judicial practice of child pornography-related crimes in my country,combined with the experience of foreign legislation,explore the criminal legislation of my country’s child pornography.As far as future legislation is concerned,my country’s criminal law should add the crimes of making,copying,publishing,selling,and disseminating child pornographic information for profit and the crimes of making,copying,publishing,selling,disseminating,and possessing child pornographic information,so as to realize the effective regulation of child pornography problem.Regarding the legal setting of new crimes,we need to clarify issues such as the location of the new crime,the boundary between the new crime,and the criteria for determining child pornography and other related crimes.In order to expand the scope of combating child pornographic information crimes,the behavior of holding child pornographic information,making,copying,publishing,and selling child pornographic information for non-profit purposes,and virtual child pornographic information should be included in the criminal law.In view of the modest principle of criminal law,viewing child pornographic information should not be included in the criminal law.When setting the range of sentencing,the principle of adaptability to crime,responsibility and punishment should be followed,and the crime and sentencing should be reasonably determined according to the type and severity of the crime.
