| In recent years,with the development of digital trade,the rules of digital trade have gradually become a key competition area of international discourse power.Compared to traditional trade,the digital economy trade has special issues such as the definition of digital products,the free flow of data across borders,the regulation of data localization,and the protection of consumer rights and interests,personal information protection and trade facilitation measures,which is different from traditional trade due to the special nature of data.With the development of digital technology,the scope of digital trade rules in recent years has also covered new topics such as artificial intelligence and digital identity.Due to the different key interests of sovereign countries,a distinct regional trend of digital trade rules has been formed in the competition for rules and discourse.Because the WTO legal framework can not solve the problems of digital trade,the proposals of e-commerce negotiations countries have also shown a divergent trend,the international consensus of digital trade rules current has not been able to forme.So major trading economies have tried to build regional trade treaty regulation.At present,the international digital trade regulations of region show fragmentation characteristics,because different economic circles have various digital trade treaties.CPTPP has a large number of member countries and a high level of digital trade regulation,so it shows a greater influence on the digital trade economy in the Asia-Pacific region.Recently,China has officially proposed to join the CPTPP,which is conducive to breaking the problem of mismatch between the scale of China’s world-leading digital trade and the discourse power of global digital trade rules at this stage.In addition it helps to improve China’s digital trade governance capabilities.However,the high-standard digital trade treaties,especially on the issue of cross-border data flow and data localization regulation,also bring challenges to adapt to CPTPP rules for China.This paper analyzes the the scope of application,regulatory content,and rule characteristics of CPTPP digital trade rules,and also compared the FTAs,RCEP,and DEPA digital trade rules that China has joined or tries to join in.This papers will also to examines the cooperation status and regulatory development tendencies of China’s international rules of digital trade,and focuses on summarizing the key points that China’s current foreign digital trade rules have not yet been involved in and need to be considered in the CPTPP negotiations.To sort out the existing legal norms in China and analyze the compliance risks that may exist in accession to CPTPP.With data classification and grading as the key point,to analyze on the divergent priorities that may be involved in CPTPP digital trade negotiations.Finally,countermeasures and suggestions are put forward for the rule response of China’s future accession to CPTPP.The Research on CPTPP digital trade rules is conducive to improve China’s modern and international data governance,breaking through difficult problems of digital trade rules,and helping China to further become a leader in the construction of an international legal framework for global cross-border data flows with an open,inclusive and positive attitude. |
