Digital trade has become an important trend of global development.However,there is no unified digital trade rule at present,the formulation of digital trade rules has become a new international focus,and free trade agreements have become an important platform for digital trade negotiations.China’s digital trade rules were scattered in the annexes of free trade agreements in the early days,and now e-commerce chapters are directly set up in free trade agreements.By analyzing the digital trade rules of China’s free trade agreements,it is found that there are some problems at present,such as exemption from digital tariff shock,irregular measures to facilitate digital trade,different regulations on cross-border data flow,and inadequate protection of users’ rights and interests.Further,it puts forward the countermeasures to construct and improve the digital trade rules in China,such as formulating reasonable digital tariff rules,defining the scope of non-discriminatory treatment of digital products,establishing a paperless trade standard system,balancing the relationship between data flow and data security,perfecting the legal system for personal information protection,and curbing the flood of unsolicited electronic information.While promoting the development of China’s digital trade,it also contributes China’s wisdom to the formulation of international digital trade rules.
