There are different opinions on the governance of limited property house.To this day,the problem of limited property house is still pending and needs further discussion.With the comprehensive victory of poverty alleviation in China,rural revitalization has entered a key promotion period.Against this background,the governance of the stock of limited property house ushered in a new turning point.For this reason,this paper discusses the various obstacles faced by the governance of limited property house,and in combination with the current rural revitalization policy,breaks down various obstacles one by one,and proposes a new governance plan,in order to solve the governance problems and promote the development of rural revitalization.After searching the research achievements on limited property house and the situation of national rural revitalization policies,this paper mainly studies the governance of the stock of limited property house from the following parts:The first part is an overview,which mainly introduces the basic connotation of rural revitalization and the definition and concept analysis of limited property house,including the current situation of limited property house in stock in China,the reasons for the emergence of so many limited property house,and the aspects that the governance of limited property house in stock provides positive significance for rural revitalization strategy in the context of rural revitalization.This chapter analyzes and responds to the above questions,laying a foundation for subsequent writing.The second part is the feasibility analysis of the stock of limited property house governance under the background of rural revitalization.First of all,the current "limited property " house is large in scale and has a wide audience,which can not be solved by all being identified as illegal buildings.The governance of "limited property" houses mainly depends on the promotion of the state and the society,so the first section of this part analyzes the feasibility of its governance based on the perspective of the state and the society.Secondly,since the birth of "limited property" real estate,although the law has not directly responded,the Constitution,as the fundamental law of our country,has not completely denied its legitimacy,and there are provisions in other levels of law that can be used in governance.The second section of this part analyzes the feasibility of governance from the perspective of the entire legal and regulatory system.Finally,whether the governance of the stock of "limited property" houses can promote the development of rural revitalization,the third section of this part takes Shenzhen City as an example to list the great achievements made by Shenzhen’s rural areas in the process of fuzzification,so as to illustrate that it is feasible in the perspective of rural development.The third part analyzes the obstacles faced by "limited property" house governance under the background of rural revitalization.First,"limited property" house has existed in China for many years,and there are many related research theories.However,from the current theoretical point of view,there is no reasonable theory of stock governance combined with rural revitalization.The second is that the culture of rural grass-roots autonomous organizations is relatively low,coupled with the aging of the rural population,and there is insufficient capacity in the governance of limited property house.In addition,a considerable part of limited property house are constructed under the leadership of village committees,and there is still a problem of insufficient internal driving force due to the relevance of interests.Moreover,grass-roots autonomous organizations and individual farmers have weak awareness of the rule of law and lack of legal knowledge,and disputes also face the problem of inadequate efficiency of the settlement mechanism.The fourth part is some reflections on the governance of the stock of limited property house under the background of rural revitalization.This part mainly includes two sections.The first section describes the principles that must be adhered to in the process of "limited property" house’s governance.The second section is mainly to remove the above-mentioned governance barriers,including balancing the interests of the government,village-collectives and the villagers,updating the governance theory of limited property house,and breaking the theoretical barriers in the context of rural revitalization;We should use the policies of rural talent revitalization,organization revitalization and cultural revitalization to strengthen grass-roots governance capacity and awareness of the rule of law,and solve the obstacles of insufficient grassroots governance capacity,low internal driving force and inefficient dispute resolution mechanism;Guided by the theory of rural revitalization,set up a special fund account under the dual supervision of the government and villagers,and introduce the preemption right system to build a mechanism for protecting the rights of farmers in the process of governance.
