The house with limited property rights is a special housing based on collective land which is accompanied by a special transformation of old villages. Rural urbanization construction and transformation of villages. In essence, it is special phenomenon accompanied with Chinese industrialization and urbanization. The key problem of the house with limited property rights is that the construction of large scale, involving a wide range, various forms, difficulty of regulation and governance and so on. The reason is mainly manifested in the following aspects, the urban-rural dual economic structure led to the division of land ownership, the profit distribution imbalance in the urbanization process,the fiscal and taxation management system and the lack of government regulation and the existing land management law which is difficult to respond the needs of the new type of urbanization.The development of New-type Urbanization brings opportunities and challenges which refers to rural land system, the reform and,governance of the house with limited property rights.We must firmly grasp the cultivated land protection, protection of farmers’ rights and interests coordinating urban and rural development, market leading and government guiding principle in the institutional innovation etc. The house with limited property rights involving conflicts between different interest subjects, the central and local legislation can ’ t meet the needs of the development of urbanization. It should be conduct a comprehensive reflection of the problems which including progressive pluralism and the policy legalization inevitability, solve the main implementation solve the diversity of main body and policy implementation of progressive multiple problems, such as a comprehensive reflection. It is necessary to clean up and improve the law, speed up the reform of rural land property rights system strengthen The rural democratic construction of grass-roots government, coordination and promotion, speed up the speed of the construction of unified planning, the development and introduction of the planning of urban and rural "real estate management law" which solve the problems of the house with limited property rights fundamentally.
