Research On Legal Issues Of Personal Information Protection In Public Health Event

In the major public health emergencies caused by novel coronavirus pneumonia,personal information played an important role in the prevention and control of the epidemic,and governments at all levels in China worked together with enterprises to achieve remarkable results in the prevention and control of the epidemic with the help of digital technology.However,due to the multiple subjects of personal information collection and the high breadth and width of information collection,a tension between public health and personal privacy is inevitably formed,presenting the phenomenon of absolute priority of public interest and lack of dialogue space and discourse power of personal privacy.This article will analyze the reasonable scope of the use and protection of personal information in the prevention and control of the epidemic and make corresponding suggestions,focusing on the most typical current public health event,the novel coronavirus pneumonia epidemic.The body of the article is divided into four parts:The first part discusses the concepts and the theoretical basis of this article,and the concepts of public health event and personal information,privacy,etc.are discussed,and typical cases are cited to prepare the theoretical basis for the following discussion.The second part examines the current situation of personal information protection in public health incidents.By sorting out the legislation related to personal information protection,the legitimacy of the collection and handling of personal information in public health incidents is pointed out,and the importance of personal information protection is highlighted through two typical cases.The legislative trends and practical measures for personal information protection in public health events in the United States and the European Union are studied and used to determine future trends in personal information protection^[39].The third part focuses on digging into the deficiencies of existing personal information protection in public health events.The imbalance between personal information protection and utilization,the deficiencies of the legal system and the limitations of industry self-regulation,the poor implementation of personal information protection enforcement in practice,and the strong impact of artificial intelligence technology on personal information security.The fourth part proposes a path to improve the protection of personal information in public health events.In-depth understanding of the properties of personal information in public health events.In terms of specific protection unfolding,firstly,the legal protection and supervision mechanism should be improved,and the criminal law system of personal information crime should be constructed.Second,improve the rights and responsibilities of personal information handling,strengthen the construction of the data application industry compliance system at the same time to make up for the shortcomings of the legal aspects of personal information protection,reasonably define the scope and types of personal information^[28],make a good balance between personal information utilization and protection,strengthen the application of the principle of proportionality,and also strengthen the publicity of personal information protection.
