| In this public health emergency,in order to effectively prevent and control the epidemic,the government and relevant departments may need to disclose the private information of the personnel involved in the epidemic,but in this process,how to collect and manage personal privacy issues urgently need to be solve.The proposal of the protection of personal privacy rights in public health emergencies has opened up a new observation perspective for the improvement of relevant systems.By analyzing the cases of personal privacy rights violations in public health emergencies,the protection of personal privacy rights is listed.At present,in the face of the conflict between the prevention and control of the new crown pneumonia epidemic and the protection of personal privacy,we need to try our best to find a balance between the two,so that it has real social practical significance.Analyze the basis for derogation of personal privacy during epidemic prevention and control,and point out the corresponding legal loopholes and the pain points such as the weak privacy protection concept of the relevant subjects responsible for collecting and storing information,and the imperfect government supervision system.Regarding the problems of personal privacy protection in the new crown pneumonia epidemic,we must not only improve the relevant legal systems such as privacy protection,but also clarify the scope and content of privacy rights,adopt the principle of proportionality as the standard for measuring interests,and balance knowledge.The conflict of interest between the right to privacy and the right to privacy,and the determination of the subject of the collection and disclosure of personal privacy information are four aspects to solve the problem,so that individual citizens,social groups and state agencies can work together to provide my country to gradually improve the layout of personal privacy protection.value guide.However,in practice,in the context of public health emergencies,my country’s laws and regulations have not made complete provisions on how to comprehensively protect personal privacy rights after being violated.The subject and scope are uncertain,the object of collecting and disclosing personal privacy is not clear,the personal privacy protection system is lacking after the public health emergency,the patient’s privacy rights were not fully desensitized when the right of privacy was disclosed,and it was not clear that all individuals would be treated after the epidemic was over.Issues such as how to deal with collected personal privacy information have added great difficulty to epidemic prevention and control.Therefore,in the face of many problems in the protection of personal privacy rights in public health emergencies,first of all,this paper proposes a response plan for the protection of personal privacy rights in response to the above problems.The government and relevant departments should pay attention to and take measures to strengthen the protection of privacy rights.Handling and protection,mainly by strengthening the government’s administrative supervision functions,clarifying the protection limits of personal privacy in public health emergencies,and improving the protection of personal privacy rights by referring to the Personal Information Protection Law,the Data Security Law and other relevant laws.Secondly,the principle of proportionality should be followed when disclosing the privacy of persons involved in the epidemic,so as to resolve the contradiction between personal privacy rights and the public’s right to know,so that both personal and public interests can be equally protected.Thirdly,the subject,content,and object of collecting and disclosing the privacy of persons involved in the epidemic must be legal,and the responsibilities of those who violate the law must be clarified,so that violations in special circumstances must be investigated.Finally,the state should improve the relevant legal system for the protection of personal privacy rights in public health emergencies,so as to achieve effective protection of personal privacy rights in the context of public health emergencies. |
