As a new economic format,platform economy plays an increasingly important role in China’s economic development.The rapid development of platform economy provides a large number of employment opportunities and jobs,which plays a significant role in promoting employment and maintaining social stability,but also brings many social problems,such as the protection of workers’ rights and interests.Platform under the economy between new employment pattern and traditional industry in working hours,working place,and there is biggish difference on the production data,from the personality property,economic property and organizational dependency three directions hammered and deconstructed the traditional labor standards,make the existing regulation of labor law system in our country is not better meet the needs of platform under the economic rights and interests safeguard laborer.This paper analyzes the impact of the rapid development of platform economy on the due rights and interests of workers,the plight of the protection of workers’ rights and interests and the causes of the plight.It is concluded that the root of the problem lies in the either-or labor security mode of the dual system in China,which protects the workers all or nothing according to whether they have established labor relations.The scope of protection of this mode is narrow,and the identification requirements are more rigid than flexible,so it is difficult to make accurate identification of labor relations under the new employment mode.China’s platform economy is in the early stage of development,while foreign countries have a higher degree of development of platform economy and more mature legal system practice.We can start from the practice of typical foreign legal systems,Such as "independent contractor" system in the United States is rich in essential elements,Japanese "contract labor" theory of laborers shall practise a system of gradient,Canada "dependent contractor" in the third protection set for labourers in order to adapt to social development path and in Italy "quasi property system" to enhance the economic dependency in the system such as the proportion of the standard of the practice fully learn it The experience,absorb bad lessons,according to the development needs of appropriate reference and improve China’s existing labor security system.According to China’s specific national conditions and the rule of law,can be maintained through optimization of labor relations of perfecting our country’s existing mode,strengthen enterprise social governance responsibility,to explore new forms of trade union organizations and build a perfect social security system measures such as multi-dimensional and multi-level and multi-field toghter with all aspects to build the new pattern of protect the laborer rights and interests of platform under the economic.
