A Study On The Optimization Of The Business Environment For Foreign Investment

The business environment of foreign investment is an important criterion for evaluating the attractiveness of a host country to foreign investment,and it is also a key factor to measure the host country’s international competition.Taking foreign investment legislation and improvement as clues,we can find out the optimization process of our country’s foreign investment business environment.Our country’s foreign investment legislation started with the three foreign investment laws("Sino-Foreign Equity Joint Ventures Law","Foreign Equity Enterprise Law" and "Sino-Foreign Cooperative Joint Venture Enterprise Law"),and has been continuously improved with the advancement of reform and opening up and the development of international and domestic economies.Among them,in order to successfully join the WTO,we passively perfect the three laws on foreign investment,and in order to implement the national treatment after admission and enhance the international competitiveness,we actively carry out the reform of the merger of two taxes and tracks,which has greatly improved the foreign investment legislation and greatly optimized the business environment of foreign investment in China.The promulgation of the "Foreign Investment Law" in 2019 has promoted fundamental changes in our country’s foreign investment management system.The "Foreign Investment Law" replaces three laws with one law,realizes the equal management of domestic and foreign investment,and lays a solid legal foundation for promoting the overall optimization of our country’s foreign investment business environment.However,there is still a lot of room for improvement in China’s foreign investment business environment.There are still some problems,such as supervision and service system,negative list system and foreign investment safety review system are imperfect.In order to continuously optimize and create a world-class business environment for foreign investment in China,it is necessary to accelerate the implementation of the Foreign Investment Law,actively promote the transformation of foreign investment supervision and service system,and strengthen the service function of the government.At the same time,it is necessary to reduce the frequency of revision of the negative list,fully disclose the legal provisions related to the negative list,so as to enhance the stability and transparency of the negative list system,and improve the foreign capital security review system by enhancing the transparency of foreign capital security review procedures and giving foreign capital procedural relief.
