Research On The Legal Aspects Of Colleges And Universities Dealing With Misconduct In Students’ Academic Papers

As an indispensable part of the management of colleges and universities,colleges and universities have the power and obligation to govern students’ academic thesis misconduct.However,if colleges and universities abuse their power to deal with students’ academic thesis misconduct,it will not only damage students’ rights,disrupt the internal management order of colleges and universities,but also undermine the country’s rule of law.Therefore,in order to better cultivate innovative research talents in the new era,orderly promote the process of governing the school according to law,and further improve the academic atmosphere of the current society,colleges and universities must strengthen the supervision of students’ academic paper misconduct and standardize their own handling behavior.At present,there are eight cases involving misconduct in academic papers of college students on the Judgment Documents Network.After analyzing and sorting out the cases,it is found that colleges and universities have the following problems when dealing with misconduct in academic papers of students: On the one hand,colleges and universities have The standards for identifying misconduct in students’ academic papers are too general,and there may be inconsistencies among colleges and universities in terms of specific identification,which stimulates conflicts between students and colleges;Problems such as the lack of education,the non-disclosure of the investigation process,and the single punishment method may affect the governance efficiency of colleges and universities;in addition,the imperfect relief system for students may also damage the rights and interests of students.In response to the above problems,comprehensive measures should be taken to regulate the behavior of colleges and universities in dealing with the misconduct of students’ academic papers.First,clarify the four basic principles that colleges and universities should abide by when dealing with students’ misconduct in academic papers,namely the principle of combination of corrections and education,the principle of proportionality,the principle of legal treatment and the principle of fairness and openness,so as to make up for the deficiencies in the legal rules of colleges and universities..Secondly,from the three levels of unifying the standards for the identification of misconduct in students’ academic papers,strictly related investigation procedures,and improving the legislative rank of relevant systems,a unified and orderly university policy and norms for dealing with students’ academic paper misconduct will be introduced.Third,improve the appeal and review procedures for college students,implement the system of recusal and hearing,strengthen the neutrality of the appeal committee,and safeguard the legitimate rights and interests of students.Finally,promote academic integrity education in colleges and universities,further play the role of the academic committee in monitoring and investigating misconduct in students’ academic papers,correct the academic attitude of college students,and improve the academic atmosphere in the school.
