Study On The Legal Issues Of Placement Of Retired Soldiers In China

The commander in chief is concerned about the millions of soldiers,a branch and a leaf is always concerned.The report emphasizes "strengthening the honor of military families and the protection of their rights and interests,doing a good job in providing services and protection for retired military personnel,and consolidating and developing the unity between the military,the government and the people",which not only points out the direction for the work of retired military personnel in the new era,but also provides fundamental guidelines.In the background of rapid economic development,China’s local institutions and personnel systems continue to develop and improve,set up the corresponding resettlement institutions,and also have introduced various policies and laws and regulations,which,to a certain extent,protects the resettlement rights of retired soldiers.However,it is difficult to avoid some legal problems in the resettlement process of our soldiers after they leave active service,and the more prominent ones are at the legislative and judicial levels.Therefore,this paper uses the rule of law to analyze the problems that arise in the process of retired soldiers’ resettlement in China,and at the same time proposes corresponding suggestions and countermeasures to promote national development and social progress by drawing on the excellent resettlement experience of foreign countries.In this paper,by studying relevant literature,policies and regulations,combined with the author’s own experience of retired soldiers’ resettlement and the experience of retired soldiers’ resettlement asked from comrades of different military age,I found that there are many problems in the resettlement process of this special group of retired soldiers.The author thinks deeply about the resettlement of retired soldiers from both theoretical and practical aspects,hoping to provide references for the forthcoming Regulations on the Resettlement of Veterans.Specifically,this paper focuses on the following five aspects: the first part is the introduction,which introduces the background,significance,literature review and research methods of this paper;the second part analyzes the placement of retired soldiers in China,and elaborates the concept and justification of retired soldiers’ placement,and the specific classification of retired soldiers’ placement methods;the third part analyzes the legislative level of retired soldiers’ placement in China.The fourth part analyzes the difficulties of China’s veterans’ resettlement at the judicial level,such as the imperfect rights relief mechanism,the lack of monitoring system of veterans’ resettlement and the lack of specialized legal aid institutions for veterans.The fifth part discusses the beneficial experience of foreign veterans’ resettlement,the improvement of veterans’ resettlement at the legislative level and the improvement of the judicial level.At the legislative level,we can enhance the standardization of legal terms,consolidate laws and regulations,introduce special laws of higher legislative rank,improve the system of supporting laws and regulations,and optimize the provisions of rights and remedies;at the judicial level,we can establish a sound system of rights and remedies for the resettlement of ex-soldiers,improve the supervision system,promote the diversified development of supervision subjects,and promote the establishment of legal aid institutions for ex-soldiers.
