Research On The Investigation Dilemma Of Minor Criminal Cases

With the improvement of the country’s overall detection capacity,the number of serious violent crimes in China has decreased year by year,while minor criminal cases related to the vital interests of the masses have shown a high and frequent trend,seriously affecting the sense of security and happiness of the masses.At the same time,in practice,the effect of the governance of minor criminal offenses has been quite ineffective,and minor criminal cases have fallen into a dilemma centered on the difficulty of solving the case,and it is urgent to explore ways to resolve this dilemma.At present,the research on minor criminal cases mostly focuses on the types of cases such as settlement,mediation,and transfer of public prosecution of minor criminal cases to private prosecution,mainly discussing the investigation mechanism of minor criminal cases,the reasons for solving the cases,and the harm caused by the unsolved backlog of cases,while paying less attention to the difficult dilemma that arises after the filing of minor criminal cases.In view of the increasingly serious problem of difficult to solve minor criminal cases,in-depth research on this has great theoretical and practical significance.Through the analysis of the current situation of minor criminal cases opened and solved by the J police station in J City,the author concludes that there are problems in the handling of minor criminal cases,such as difficulty in filing,detection,and recovery of stolen goods,and the main difficulties that are difficult to solve are concentrated in such aspects as not breaking and not standing,breaking without standing,and standing without investigation,etc.,and these problems have long existed and caused a crisis of people’s trust in the public security organs.One of the main reasons why it is difficult to solve minor criminal cases is the insufficient investigation resources,and the public security organs have tilted important resources over serious and important cases,and relatively speaking,the investigation resources for minor criminal cases are relatively insufficient.Not only that,the negative impact of interest-oriented due to the inconsistent identification standards for minor criminal cases leading to different trends in similar cases and imperfect assessment systems is also an important reason.In view of the above problems,they should be solved from the improvement of the detection system for minor criminal cases and the improvement of detection technology.Among them,institutional improvements help to change the subordinate status of minor criminal cases,while technological improvements are conducive to improving the efficiency of solving minor criminal cases.
