| In recent years,the rapid development of the internet has permeated into every aspect of people’s lives.Virtual property on the internet,as a natural product of internet development,has also brought new considerations for protecting citizens’ property security and ensuring social order stability due to its widespread use.As the quantity of transactions in the virtual property market has continued to rise,related disputes have also emerged.After the establishment of the Civil Code,virtual property was officially included as a new type of property in the law,but the concept,types,and protection methods of virtual property have not been defined in current criminal law.This has resulted in a lack of consensus among judicial practices regarding how to calculate the amount involved in virtual property crimes,and frequent occurrences of different verdicts for the same case,which not only constrains the development of the internet economy but also undermines judicial credibility.At present,virtual property is widely regarded as having the attributes of property,and how to recognize its value has become a new problem.There are many types of virtual property,each with different value attributes,making it impossible to form a unified recognition rule.This article selects virtual property in online games,which is closest to people’s daily lives,as the research object to explore the recognition method of the amount of criminal activity involving virtual property in criminal cases related to online games.This article believes that the value attribute of virtual property does not come directly from human social labor,but rather from the ability to exchange it with legal currency at a certain ratio.The construction of virtual property value recognition rules should not treat it as a whole,but rather conduct a typological analysis,after clarifying the different paths through which virtual property in online games obtains value attributes,and then use the form of expression of its value source to determine the price recognition method.In this way,problems of a lack of standardized judicial practices can be solved,and the value of virtual property can be reasonably recognized by differentiating among types and adapting to local conditions. |
