Study On The Path Of Relief For Occupational Injury Of Online Contract Deliverers

With the outbreak of the epidemic,the domestic economy has been sluggish,and the real estate industry has been severely affected.Real estate enterprises have been hit by thunderstorms,and bankruptcy has become a nightmare for real estate enterprises.The impact of bankruptcy on real estate enterprises is enormous,involving numerous rights holders.As a relatively vulnerable group of homebuyers,they often find themselves in a helpless situation when facing various unfinished properties,and have added residency rights from the Civil Code,It can be seen that China has been actively promoting the protection of the basic survival rights of residents,while the bankruptcy of real estate enterprises and the protection of the basic survival rights of the vulnerable group of homebuyers are also worth promoting.In the bankruptcy practice of real estate enterprises,granting priority compensation rights to homebuyers is the most effective safeguard measure among the numerous rights of homebuyers.However,currently,the legal system for the priority compensation rights of homebuyers after bankruptcy of real estate enterprises in China still needs to be improved,and there are also shortcomings in judicial practice.Therefore,studying the priority compensation rights of homebuyers is of great significance.Apart from the introduction and conclusion,this article is mainly divided into four parts,which respectively study and discuss the protection of homebuyers’ priority to compensation from four aspects.The first part mainly elaborates on the uniqueness of real estate enterprises,further demonstrating the importance of establishing priority compensation rights,and explaining the connotation of the priority compensation rights of homebuyers.The second part mainly explores the basic legal principles of the buyer’s priority right to compensation in the context of bankruptcy of real estate enterprises.Secondly,analyze the priority compensation rights of homebuyers,the priority compensation rights of construction project prices,and the mortgage rights,and compare and explore the repayment order of the three rights that all enjoy priority rights in the case of conflicts among the three rights.The third part mainly elaborates on the obstacles that exist in the priority compensation rights of homebuyers after the bankruptcy of real estate enterprises.The fourth part elaborates on the improvement path of homebuyers’ priority compensation rights from the legislative and judicial practices.At the same time,drawing on relevant foreign legislative experience,this article further understands and deepens the improvement path.
