With the rapid development of market economy and food science and technology,the kind of food in our country is becoming more and more diverse,and people are enjoying delicious at the same time,are assuming great risk caused by the problem food.From the food safety situation in recent years,the production and sale of toxic and harmful food crime situation is still severe,the public security organ is at the forefront of the judicial link,playing a vital role in the fight against such crimes.This paper explains the concepts related to the production and sale of toxic and harmful food crimes,summarizes and analyzes the production and sale of toxic and harmful food crimes on the basis of the current situation and characteristics,combined with the investigation practice,discusses the difficulties encountered by the public security organs in the process of investigating such cases,and puts forward targeted investigation countermeasures.Specifically,this paper mainly discusses the crime of producing and selling toxic and harmful food through four parts:The first part: the production,sales of toxic and harmful food crime related concepts.This part summarizes the concepts of food,toxic and harmful food,crime of producing and selling toxic and harmful food,compares and distinguishes the crime of producing and selling food that does not meet safety standards and the crime of releasing dangerous substances,and divides them into two criminal behavior modes of producing toxic and harmful food and selling toxic and harmful food.It lays a conceptual and legal foundation for the following research.Part two: the present situation and characteristics of the crime of producing and selling poisonous and harmful food.This part selects the cases of this kind of crime in recent years with the help of the Chinese judicial documents network.Through statistical analysis,it is found that this crime has the characteristics of serious social harm,strong concealment of criminal activities,professional organization members and network sales channels.The third part: production,sales of toxic and harmful food crime investigation predicament.Based on investigation practice and specific cases,this part analyzes and points out the multiple difficulties that the current investigation organs face in cracking down on such crimes: first,it is difficult to find clues,second,it is difficult to extract evidence,third,it is difficult to cooperate in investigating and cracking,and fourth,it is weak in professional investigation ability.The fourth part: the investigation countermeasure of the crime case of producing and selling poisonous and harmful food.This part puts forward strategic suggestions from four aspects of clue,evidence,mechanism and team construction.First of all,we should strengthen the consciousness of research and judgment and explore the source of clues.Secondly,we should pay attention to investigation and evidence collection and perfect the evidence chain.Third,to perfect the execution mechanism,forming a joint force;Finally,it is necessary to strengthen the construction of the team and enhance the professional ability of the investigators.
