Research On The Prevention And Control Measures For Crimes Of Using The Internet To Fabricate And Spread False Information

Against the backdrop of the continuous development of internet information dissemination technology,various media platforms and instant communication software have become important ways for people to obtain information and communicate in daily life.Expressing various opinions and forwarding various information on the internet has become a daily behavior of netizens,and in this process,a large amount of false information is generated,seriously affecting social stability.In 2015,Article 32 of the Ninth Amendment to the Criminal Law of China added the crime of fabricating and intentionally disseminating false information,specifically regulating the use of information networks to fabricate and spread false dangerous situations,disaster situations,epidemic situations,and police situations that disrupt social order.This indicates that the country is fully aware of the social harm of such crimes and has partially criminalized the previous acts that were generally subject to administrative penalties.At present,various sectors of society have achieved certain results in the governance research of using the internet to fabricate and disseminate false information.However,there is still room for further enrichment in research perspectives,expansion in research methods,insufficient focus on research objects,and improvement in prevention and control measures.This article takes the criminology theory as the angle of view,adopts the literature research method,the statistical analysis method,the questionnaire survey method and the interview method to study the crime of using the network to fabricate and disseminate false information.Under the logical thinking of crime status,crime reasons,and crime countermeasures,based on the description of the phenomenon of fabricating and disseminating false information through the internet,the characteristics of the crime are summarized,the reasons for the crime are analyzed,and comprehensive and effective prevention and control measures are proposed.The article mainly consists of five parts:The first part mainly introduces the research background,significance,and latest research status in relevant fields both domestically and internationally,and provides a review.Clarify research methods,explain data sources,and introduce relevant theories to lay the groundwork for subsequent research.The second part first defines the concept of false information and clarifies the core concepts.Secondly,the concept of the crime of fabricating and disseminating false information through the internet should be clearly defined to ensure the accuracy of the research object.Finally,it summarized and introduced the criminal and administrative laws and regulations in China that have long regulated the illegal crime of fabricating and disseminating such false information.The third part mainly analyzes the current situation and characteristics of the crime of using the internet to fabricate and disseminate false information.Firstly,using the statistical criminal and administrative cases,combined with the punishment case notifications published by various provinces and cities in recent years,introduce the basic status of crime.Secondly,by extracting and summarizing the key elements in statistical cases,the characteristics of such crimes are summarized,mainly including the characteristics of the criminal subject,criminal motivation,criminal means,criminal spatiotemporal characteristics,and criminal consequences.Finally,based on the induction of criminal characteristics,a summary is made of the two main forms of criminal behavior,further deepening the understanding of criminal phenomena from the perspective of typical behavior patterns,laying the foundation for analyzing the causes of crime in the following text.The fourth part analyzes the criminal reasons for using the internet to fabricate and disseminate false information.On the basis of in-depth analysis of the characteristics of crime,combined with professional concepts in criminal psychology,criminal sociology and other disciplines,typical cases in practice,questionnaire and interview data,in-depth analysis of the causes of crime at different levels.We will conduct in-depth analysis of the factors that induce and promote the emergence and development of crime from the perspectives of criminal subjects,government governance,social participation,cyberspace,and legal regulations,guiding the proposal of crime prevention and control measures in the following text.The fifth part proposes corresponding prevention and control measures for different levels of criminal reasons.By relying on the government to enhance its own capabilities and enhance the level of collaborative cooperation,strengthen the self-discipline of the online media industry,improve legal regulations,standardize and strictly enforce laws,and promote the participation of social forces in prevention and control measures,multiple forces work together to achieve effective prevention and control of crimes of using the internet to fabricate and disseminate false information.
