Study On Governance Of Off-campus Training Institutions By Law

As one of the forms of private education,off-campus training institutions play an active role in enriching the education system.However,the tendency that the public welfare of education in off-campus training institutions is replaced by the profit-seeking of capital appears,causing a lot of chaos.The first is to make use of parents’ mentality of wanting to obtain high-quality educational resources,using marketing means to create educational anxiety and education internalization;Second,it increases the burden of primary and secondary school students and poses a serious threat to their physical and mental health.Thirdly,teaching methods that do not conform to the law of education are used to carry out educational training activities,which disturb the normal teaching order of schools and occupy the dominant position of public education.Fourth,it has caused endless educational disputes within the social scope.Since 2018,the supervision of off-campus training institutions has been gradually paid attention to,but the effect has been unsatisfactory.Therefore,it is necessary to put forward new requirements for the governance of off-campus training institutions.The reasons for the disorder of off-campus training institutions can be summarized as the double failure of market regulation mechanism and government supervision.The "double reduction" policy,introduced in July 2021,marks an unprecedented level of strict governance over off-campus training institutions.The "double reduction" policy is clearly stipulated from the aspects of access examination and approval of off-campus training industry,operation behavior of training institutions,supervision mechanism of government departments,etc.,providing a direct policy basis for the governance of off-campus training institutions.However,how to normalize governance by government departments also needs to be guided by the idea of rule of law,which is specifically manifested in the improvement of legislation,the solution of law enforcement dilemma,and the construction of appeal expression mechanism.In view of this,this paper analyzes the governance situation of off-campus training institutions as a research topic,and probes into the realization of the governance rule by law of off-campus training institutions according to the realistic dilemmas.This paper is divided into the following five parts: the first part is the introduction,focusing on the topic background,research status,theoretical significance and application value of the research;The second part defines the concepts,characteristics,classification and practical significance of governance of off-campus training institutions.The third part demonstrates that the governance of off-campus training institutions has the attribute of rule of law.Taking the implementation of the "double reduction" policy and the promotion of the rule of law in education as the practical basis,and the idea of the rule of law in education and the idea of administration by law as the academic basis,it discusses that the governance of off-campus training institutions should run through the idea of rule of law.The fourth part analyzes the difficulties and obstacles in the governance of off-campus training institutions,including the imperfect legal system,the imperfect administrative law enforcement mechanism and the unclear appeal resolution mechanism,from the three aspects of governance basis,prior administrative permission and post supervision,and the appeal expression of off-campus training institutions.In the fifth part,based on the summary of the governance predicament of off-campus training institutions,the corresponding countermeasures are put forward.The first part is to improve the governance legal norms system,formulate specialized legal norms and resolve the conflicts in the content of existing legal norms.The second part is to improve the multi-department joint law enforcement mechanism and the multi-subject collaborative governance model.Third,the industry association should take the lead in improving the appeal expression mechanism of training institutions.Through institutionalization,legalization and long-term governance,the chaos caused by off-campus training institutions can be truly solved,so that off-campus training institutions can return to the due educational track and play a positive role in fulfilling the fundamental educational task of cultivating virtues and cultivating people.
