| As a legal system in China,the pre-sale system of commercial properties has been implemented for more than twenty years since its introduction in Hong Kong,and has played an important role in alleviating the capital constraints of the real estate market and promoting the rapid rise of the real estate industry in Chinese mainland.However,with the rapid development of economy and society,the social contradictions and market environment have changed dramatically,and the lax policy regulations of the pre-sale system,the inherent defects of the system and the lack of government supervision responsibilities have caused numerous problems and disputes since the system has been in operation,which not only affect the harmony and stability of society,but also hinder the healthy development of the real estate market.The call from all walks of life for the abolition of the pre-sale system of commodity houses is constantly rising.How to reform the pre-sale system based on long-term development,strengthen the supervision and policy implementation of the pre-sale system,and effectively safeguard public interests has posed a new challenge to our government.Based on the general system theory,government regulation and other theoretical foundations,this paper conducts a detailed study on the current situation and problems of the implementation of the administrative supervision policy of commodity house pre-sale in S city.Firstly,it elaborates the research background and significance of the administrative supervision of commodity house pre-sale,analyzes and summarizes the research overview of the domestic and foreign academics on the supervision of commodity house pre-sale,establishes the framework of the line of this paper,and after determining the research method and innovation points,within Smith Model,we define and clarify the relevant concepts,establish the theoretical basis of this paper,and start the research in this way.Secondly,we analyze the current situation of the pre-sale of commercial properties and the specific division of labor among the regulatory agencies,and analyze the main measures and achievements based on the actual administrative supervision of the pre-sale of commercial properties in S city.Again,the main problems in the implementation of the administrative supervision policy of commodity house pre-sale in S city are discussed through specific interviews and surveys,and the reasons behind these problems are analyzed.Then,based on the analysis of the whole paper,we propose countermeasures to improve the implementation of the administrative supervision policy for the pre-sale system of commodity houses in S city.Finally,a summary and outlook of the full research is presented.This paper finds that: firstly,the implementation of the administrative supervision policy for the pre-sale of commodity houses in S city mainly suffers from the problems of insufficient enforcement of the supervision policy,light punishment of the enforcement of the supervision policy,insufficient optimization of the enforcement of the supervision policy,and insufficient supervision of the enforcement of the supervision policy.Second,the cause of the above problems is mainly the regulatory policy implementation system has not been perfected,the regulatory policy enforcement function is not smooth enough,the implementation of the main responsibility of regulatory policy implementation is not enough,the regulatory policy implementation supervision system is not optimized.Thirdly,in order to better solve the above problems,this paper puts forward the optimized countermeasures for the implementation of administrative supervision policy of commodity house pre-sale in S city from four aspects: improving the administrative supervision policy implementation system of commodity house pre-sale,improving the enforcement function of supervision policy of government departments,implementing the main responsibility of supervision policy implementation,and optimizing the supervision system of supervision policy implementation. |
