Research On The Application Of The Crime Of Huge Amount Of Property With Unknown Sources

Since the 18 th National Congress of the Communist Party of China,a large number of corrupt elements have been punished,and the anti-corruption work has achieved certain results.But as long as the breeding ground for anti-corruption remains,the struggle cannot be stopped.In the new era,the means of corruption crimes in society are more covert,and the detection of cases is difficult,posing higher requirements for anti-corruption work.The crime of huge amounts of property with unidentified sources is in line with China’s current anti-corruption policies,but there are issues in the application of this crime,such as the mismatch between the penalty and the alarming amount of crime,and it is easy to become a "protective umbrella" for criminals to escape punishment,which has become a hot topic of attention.The main reasons are the legislative defects of the crime and the incomplete judicial determination system.This article defines the relevant theories of the crime of huge amount of property with unknown origin,and combines existing legal provisions and court judgment samples to conduct research and provide countermeasures on the application of this crime from both legislative and judicial aspects.This article combines theoretical analysis with empirical research,collects,collates,analyzes,and compares court effective judgments in the past decade,studies the current application situation of the crime of huge amounts of property with unknown sources,analyzes the existing problems of this crime such as the absence of laws and regulations,interpretation,and judicial determination difficulties,and proposes countermeasures to further improve the application of the crime of huge amounts of property with unknown sources from both legislative and normative aspects,Thereby strengthening the anti-corruption function of the crime of huge amounts of property with unidentified sources.
