In recent years,our sharing economy has developed rapidly.In just a few years,it has permeated the whole social life at an amazing speed,changing people’s lifestyle and thinking mode,and becoming an important driving force for the rapid growth of our digital economy.However,with the large-scale development and gradual maturity of the sharing economy industry,this new form of business has gradually exposed some problems.The sharing economy market is changing from a competitive situation to an oligopoly situation,and some sharing economy platforms are increasingly controversial.Sharing economy platforms such as Didi and Meituan have raised concerns about abuse of dominant market position in the sharing economy industry by using big data and price discrimination.If these behaviors are not regulated in time,they will damage the rights and interests of consumers and workers,and destroy the fair market competition order.The traditional anti-monopoly law system has a lot of discomfort in dealing with the monopoly phenomenon of emerging business forms such as sharing economy,while the abuse of dominant market position by sharing economy enterprises which have a large number of market shares needs to be effectively regulated.Therefore,starting with typical performance of abuse of dominant market position in the sharing economy industry,this paper takes ride-hailing industry and takeout platform industry,which have the highest monopoly risk in the sharing economy industry,as the main research objectives.On the basis of combing the relevant legislation regulating the behavior of abuse of dominant market position in our country,and combining with the characteristics of the sharing economy industry,This paper puts forward some suggestions to perfect the legal regulations on abuse of dominant market position in sharing economy industries,so as to optimize the development environment of sharing economy in our country.Specifically,in terms of structure,this paper is divided into four parts in addition to the preface and conclusion.The first part introduces the basic characteristics of the sharing economy,states the necessity of regulating the abuse of dominant market position in this industry,and divides the sharing economy into two types,so as to determine the scope and content of this paper.The second part analyzes the current legislation and law enforcement status of the regulation on abuse of dominant market position in the sharing economy industries,and introduces typical abuse behaviors and competition status in the current industries.The third part starts with the dilemma of legal regulation of abuse of dominant market position in sharing economy industry,extracts the core legal issues to be solved on the basis of the above,and analyzes the causes of the difficulties in regulation of abuse behavior.The fourth part,aiming at the above problems,puts forward countermeasures and suggestions to improve the legal regulation of the abuse of dominant market position in the sharing economy industries from four aspects respectively,in order to promote the healthy and orderly development of the sharing economy industries in our country.The emergence of sharing economy is of great significance for optimizing the allocation of social resources and promoting residents’ employment.However,the disorderly development of the market of sharing economy is undoubtedly contrary to the concept of sharing economy.At present,the monopoly problem of platform enterprises has long attracted the attention of scholars and anti-monopoly law enforcement departments.This paper focuses on the sharing economy industry,analyzes its characteristics and specific abuse behaviors,further discusses the monopoly problems,and on this basis,gives suggestions to improve the abuse of dominant market position in the regulation industry.
