The Practical Dilemma And Breakthrough Path Of The ’Three-adjustment Linkage’ Mechanism In Resolving Social Contradictions And Disputes

The ’ mediation system ’ is a democratic legal system in China,which plays an important role in resolving contradictions and disputes among the people and promoting the construction of harmonious social relations.With the profound adjustment of China ’s social structure,income distribution and interest pattern,various contradictions and disputes are increasing,and the pressure of dispute resolution is increasing.The traditional contradiction resolution model can no longer be fully qualified to stop contradictions and disputes.In recent years,in order to effectively solve these problems,various localities have been exploring the working mechanism in operation.Under the call and support of the Party Central Committee and local governments,some places have explored and established the linkage mechanism of people ’s mediation,judicial mediation and administrative mediation,that is,the " three mediation linkage " mechanism.The " three mediation linkage " mechanism refers to the organic combination of people ’s mediation,administrative mediation and judicial mediation,and fully integrates the three mediation resources to resolve conflicts and disputes.This is a new exploration to improve China ’s dispute resolution mechanism.In order to better combine China ’s national conditions,seek truth from facts to establish a ’ three mediation linkage ’ mechanism,rationalize the relationship between people ’s mediation,judicial mediation and administrative mediation,give full play to their respective advantages,achieve positive interaction,and improve the efficiency of resolving conflicts and disputes,it is necessary to conduct in-depth research on the ’ three mediation linkage ’ mechanism.The completion of this thesis is based on the main content of the ’ three-adjustment linkage ’ mechanism and its related theories,combined with the author ’s internship research.Based on the current situation of A city,through literature research,interviews and questionnaires,this thesis makes an in-depth study and analysis of the operation status of the " three-adjustment linkage " mechanism in A city,and combs the working pattern,institutional setting,system construction,linkage process,operation guarantee and other aspects of the mechanism.This thesis summarizes the operation results of the " threeadjustment linkage " in A city in the actual implementation process,and analyzes the difficulties,causes and breakthrough paths in the operation of the " three-adjustment linkage " mechanism in A city.This thesis finds that the mechanism has some difficulties,such as unclear scope of mechanism,imperfect legal regulation,lagging information platform and imperfect supporting measures.After analyzing and thinking about the dilemma,this thesis puts forward some thoughts on the breakthrough path of these dilemmas from the aspects of strengthening collaborative operations to explore the new situation of dispute resolution,optimizing the collaborative governance work system,strengthening the legalization process of collaborative governance,strengthening the resource guarantee of collaborative governance,and building the information platform of collaborative governance.Although the ’ three mediation linkage ’ mechanism is the product of economic and social transformation,prominent contradictions and disputes,and the needs of mass mediation,it has a positive effect on promoting the process of governing the country according to law.However,in the face of the development trend of new and complicated contradictions and disputes at the grass-roots level in modern society,the mechanism still needs to be further developed,standardized and improved to ensure that it plays the greatest role in solving social contradictions and disputes.Through the formulation and implementation of a series of measures,contradictions and disputes will be resolved at the grass-roots level.
