| With the increasing demand of the people for higher levels of judicial justice,the reform of the judicial responsibility system is also gradually advancing,One of the most eye-catching is the similar case retrieval system launched by the Supreme People’s Court.The guiding case system and transparency of judicial documents established in past judicial reforms have provided institutional prerequisites for case retrieval,while the development of big data and artificial intelligence has provided a technical foundation for case retrieval.Although it is currently in the initial stage of development and still has shortcomings in practical operation,it still has bright prospects in promoting judicial progress.If appropriate improvements are made on the current basis,case retrieval can better maintain fairness and improve efficiency.This article is based on the development of category case retrieval,analyzing category case retrieval from the perspective of maintaining fairness and improving efficiency,considering areas for improvement and attempting to propose corresponding countermeasures,in order to improve the category case retrieval system.The first part of this article is an introduction.As a part of the overall article,the introduction mainly elaborates on the background and research significance of this topic,starting with the introduction of the main theme of this article,and briefly describes the research status and methods of case retrieval through a review.The second part of this paper combs the development,theory and practical application of case retrieval in recent years,and summarizes the problems.The third and fourth parts of this article,from the perspective of maintaining fairness and improving efficiency,discuss the significance of case retrieval for these two judicial values,and continue to identify problems and explore the value of optimizing judicial practice.The fifth part of this article attempts to propose countermeasures to better serve judicial practice from the perspective of maintaining fairness and improving efficiency. |
