As an important component of administrative law enforcement,off-site law enforcement combines advanced technology with administrative activities,enhancing administrative efficiency and reducing enforcement pressure.It effectively addresses the challenging issue of "limited manpower and numerous cases." With the further integration of artificial intelligence,off-site law enforcement has achieved a leap from automated administrative assistance to complete automation.Machine discretion liberates humans from tedious and high-intensity enforcement work,promoting new transformations in government social governance systems and models,and showcasing broad prospects for development.However,as research deepens,the drawbacks of technological power are gradually emerging.To limit the adverse effects of uncontrolled technological expansion and power generalization,a response is needed through the constraints and regulations of the rule of law.Chapter One provides an overview of artificial intelligence and off-site law enforcement.By analyzing divergences in concepts from different theoretical doctrines and academic viewpoints,the exact meaning of off-site law enforcement is clarified.Moreover,a comparison is made between off-site law enforcement and other similar concepts,highlighting its advantages such as efficiency,separation of investigation and prosecution,and objectivity and fairness.Finally,the relationship between artificial intelligence and off-site law enforcement is analyzed,including the origin of artificial intelligence,its development status in our country,its applications in off-site law enforcement,and the significant importance of integrating it with off-site law enforcement methods.Chapter Two taking practical examples from three typical administrative domains such as urban management,environmental protection,and traffic management to analyze the current development status of off-site law enforcement in various application scenarios.The disparities in data collection types,data accuracy,and evidentiary strength among different application scenarios are contrasted to lay the foundation for the subsequent synthesis and conclusion of issues.Chapter Three systematically reviews the legal and technical problems facing off-site law enforcement and examines the reasons behind these issues.Specifically,it’s noted that streamlined enforcement procedures compromise the protection of the relative party’s right to be informed,state a defense,and seek remedy.The clash between the demand for off-site law enforcement driven by an outdated legal system contradicts principles of reasonable administration,proportionality,and the combination of punishment and education.Overreliance on technology leads to algorithmic opacity,inadequate supervision of enforcement data erodes government credibility,machine discretion encroaches on decision-making authority,making human review a mere formality,and allowing administrative entities to evade responsibility,becoming technological puppets.Chapter Four addresses the issues encountered in the aforementioned practical applications by providing regulatory pathways from procedural and substantive aspects.Firstly,it proposes limiting the scope and applicability of off-site law enforcement,granting more rights to the relative party for enhanced protection,establishing diverse precision notification strategies and artificial intelligence driven off-site law remedy models.Secondly,it suggests constructing an enforcement system consisting of "judicial interpretations +local legal norms + guiding cases," standardizing the setup of off-site law enforcement facilities,and promoting education models centered on humane care rather than punishment.Lastly,it advocates for strengthening opinion solicitation,enhancing the duty of administrative agencies to provide justifications,discerning and purging infringing data,establishing rules for the removal of irrelevant data,intensifying scrutiny of third-party technical entities,and ensuring that administrative enforcement reverts to its governance origin principle "putting humans at the center".
