Research On The Difficulties And Strategies In The Execution Of Civil Lending Cases

Since the 21 st century,private lending has become an indispensable part of China’s multi-level credit market by virtue of its flexible and diverse forms,easy and simple procedures,fast and quick financing and other advantages,bringing a lot of convenience to people’s production life and adapting to diversified financing needs.Along with the continuous growth and expansion of the scale and scope of private lending,the legal disputes arising from it are also growing rapidly.Due to the existence of irregular guarantee and unsound supervision of private lending,the execution rate is low and the execution period is long after the case is completed and entered into the execution procedure,which has become one of the difficulties faced by the courts in the execution work.Under the goal of "effectively solving the difficulties of enforcement",it is important to solve the enforcement problems of private lending disputes to maintain the authority of law,protect the interests of the parties,guarantee the safety of economic transactions and promote the prosperous development of market economy.This thesis uses case analysis and literature analysis to study the current situation of execution of judgments and rulings in civil lending disputes,and sorts out the legal and practical difficulties in the execution of judgments and rulings in civil lending disputes and conducts corresponding strategic research,expecting to contribute to the solution of such problems through legal channels.In the first chapter,the background and significance of the thesis are explained,and the current situation of the research,research ideas and research methods are also sorted out.In the second chapter,the concept of private lending is theoretically analyzed.The relationship between private lending and financial lending is also sorted out,and the characteristics and problems of private lending are derived.In the third chapter,the problem of execution of private lending disputes has long existed and manifested in various forms.How to solve the problem of difficult execution of private lending disputes is a difficult and painful point in the execution work of people’s courts.This chapter summarizes the difficulties in the execution of civil lending disputes through relevant cases,and analyzes the causes of the difficulties in the execution of civil lending disputes from three aspects,such as parties,courts and other factors.Chapter 4,cracking the dilemma of the execution of civil lending dispute cases requires strengthening legislation and increasing technical investment,and on the basis of the analysis of the difficulties and causes of the execution of civil lending disputes,corresponding strategies are studied from three parts,such as party level,court level,and other levels,to help achieve the goal of completely solving the execution difficulties.
