Research On Civil Execution Deterrence Mechanism

The persistent problem of "difficulties in enforcement" has been eroding the authority of the court since it was created,and has prevented creditors from realizing their claims.In response to this problem,the Supreme People’s Court continuously explored and innovated and issued a series of civil deterrent measures.China’s implementation of the deterrence mechanism is a mechanism that gathers all forces and social resources under the leadership of the courts,uses the role of the social credit system,sets various restrictions on the enforced person,and forces them to fulfill the obligations determined by the effective legal documents.The new way out of the "difficult to implement" problem is a sharp sword hanging over the head of the "Lao Lai".Contrasting with some developed countries in law,China’s civil execution deterrence mechanism has problems such as lack of legislation,limited deterrent punishment measures,and inadequate supporting systems.With regard to the above issues,the article analyzes the basic connotations and practical obstacles of the mechanism,and proposes that the system should be implemented from the aspects of accelerating the enforcement of legislation,perfecting and restricting specific deterrence measures such as high consumption,and perfecting the supporting systems such as the credit investigation system and property investigation.perfect.
