Research On Legal Protection Of Enterprise Data Property Rights And Interests

Enterprise data is characterized by modernization,intelligence and high efficiency,and plays a vital role in today’s fast-paced social development.But the present law of enterprise data property rights protection there is a legislative shortage.After analyzing typical cases in Chinese data market,the author finds that the direct cause of disputes is unclear ownership of enterprise data,ambiguous property rights and interests,etc.In the case of disputes over the above rights and interests,the general provisions of anti-unfair competition law commonly used by the litigant court can only provide negative legal interests protection for the enterprise data controller.Data controllers cannot actively and effectively protect their own property rights and interests,which leads to the fundamental problem of the protection of enterprise data property rights and interests,which is difficult to be solved through the existing legal rules.Starting with typical cases of data disputes,this paper analyzes the concept and legal nature of enterprise data,and makes a thorough study of the current legislative status,academic research status and judicial protection status of enterprise data property rights and interests in China.At the same time,it summarizes the legal protection measures of enterprise data property rights and interests in Europe and America.Then,it puts forward some suggestions on legal protection of Chinese enterprise data by establishing new protection mode of enterprise data property rights,and proves the attribution of enterprise data property rights and the boundary of enterprise data property rights.
