| With the deepening of China’s economic system reform,the awareness of workers’ rights protection has been strengthened.In recent years,labor dispute cases have increased significantly,and the difficulty of handling has also gradually increased.At present,the processing of labor disputes faces great challenges.As the representative of safeguarding the rights and interests of employees,trade unions play a very important role in the settlement of labor disputes.The current Labor Law of the People’s Republic of China,Trade Union Law and other laws and regulations also give trade unions the legal function of participating in the settlement of labor disputes.At present,although trade unions in our country have played an active role in the negotiation,mediation,arbitration and litigation of labor disputes,some shortcomings have been exposed in practice,which makes trade unions play an inadequate role in the settlement of labor disputes.Therefore,strengthening the ability of trade unions to deal with labor disputes and balancing the relationship between enterprises and workers is of great practical significance for the construction of harmonious labor relations.Based on the theory of harmonious labor relations and the theory of fairness,this paper adopts the method of literature analysis and investigation,and on the basis of explaining the basic theory of labor dispute settlement of trade union participation,it combs the current situation of labor dispute settlement in P District of B City,discusses and analyzes the existing problems and reasons of labor dispute settlement of trade union participation in P district of B City,and puts forward solutions.Through the research,it is found that due to the weak construction of the trade union itself,the shortage of professional talents for the trade union to participate in the settlement of labor disputes,the imperfect laws,regulations and policies,and the ambiguity of job responsibilities,etc.,the trade union in P District of B City does not fully play its functions in the settlement of labor disputes.Based on this,this paper puts forward the following countermeasures: First,strengthen the construction of trade union itself by broadening the coverage of trade union,supplementing the source of funds and strengthening the ideological education of trade union members;Secondly,expand the selection channels of trade union members,strengthen the training of trade union members to enhance the ability of trade union to deal with labor disputes;Third,improve the trade union participation in labor dispute mediation mechanism,trade union interaction to resolve labor disputes,improve the trade union participation in labor dispute handling mechanism;Finally,by implementing the power allocation of the trade union and clarifying the division of duties of the trade union,the post responsibilities of the trade union participating in the settlement of labor disputes are detailed,and then the implementation of the functions of the trade union is enhanced.This paper analyzes the role of trade union participation in labor dispute processing based on the concrete example of P area in B City,and puts forward diversified and all-round improvement countermeasures,which strengthens the function of trade union safeguarding workers’ rights and interests,alleviates labor relations contradictions,and further brings some reference for improving the ability of trade union participation in labor dispute processing in China. |
