Research On The Fair Use System Of Current Affairs New

Current affairs news is an important way for the public to obtain information.China’s law gives current affairs news copyright,but there must be restrictions.In order to balance the original achievements of current affairs news creators and promote the dissemination and flow of news information,China’s copyright law defines the legal situation of the rational use of current affairs news.However,in reality,due to the rapid development of new online media,the fundamental changes in the news industry and the special attributes of news works,some we media,aggregate search and other defenses of infringement based on the principle of non copyright or fair use of current affairs news.From the surface reason,the reason for the problem is that the understanding of the fair use system in the copyright law is not deep enough,and the laws and regulations lag in the process of adapting to the development of media.But from a deeper point of view,it is because the new trend of media development has led to changes in the economic interests between copyright owners and users.This paper makes a comprehensive analysis of China’s current copyright legal system and discusses it from four aspects.First,it puts forward the copyright problems existing in the rational use of current affairs news,including the applicable subject of rational use,the balance of interests in current affairs news industry,the dilemma of legal provisions and rights protection,and compares the current affairs news copyright protection systems in the United States,Europe,Japan and other developed countries.Second,from the aspect of internal causes,this paper analyzes the problems existing in the fair use system of current affairs news,expounds the social welfare,practical needs and interest demands,and makes it clear that the fair use of current affairs news works has its particularity and is extremely necessary,and there is no legal blind spot.Third,from the perspective of legal system,this paper describes the institutional problems of the rational use of current affairs news,and defines the judgment criteria of the rational use of current affairs news.Fourth,combined with the current legal situation in China,fully consider the legal protection of rights,innovate and put forward relevant measures for the rational and legal application of the fair use system,as well as legal protection means for the copyright infringement of current affairs news works,so as to improve people’s awareness of copyright protection.
