Abstract/Summary:
In the new era of rapid change of information technology and rapid development of financial market,the problem of information security of financial consumers is becoming increasingly prominent.How to effectively carry out information security protection and effectively protect the fundamental rights and interests of the masses is a problem that the banking industry is focusing on to improve service quality and avoid financial risks.In addition,from the macro level,solving the problem of information security rights and interests protection and supervision of financial consumers is not only a positive response to the rapid rise of technology finance,but also an inevitable requirement for guiding the healthy development of the banking industry in China.In view of this,this paper,guided by the bimodal supervision theory,discusses the current personal information security rights and interests protection policy in China,absorbs foreign legislative experience and supervision mode,learns the core ideas of the overseas sandbox supervision mode,and combines the current development of China’s financial market to optimize and improve the information security rights and interests protection system of domestic financial consumers.This paper includes five parts.The first part,theoretical definition,in-depth explanation of the basic connotation of the concept of financial consumers,lays the foundation for the analysis of domestic information security supervision issues later,and expounds Taylor’s bimodal supervision theory.The second part analyzes the current situation of the supervision of the information security protection of financial consumers in the banking industry,summarizes and sorts out the current relevant laws and regulations,and discusses and studies a series of measures taken by the banking industry in w City in terms of information security rights and interests protection and its supervision status from the three perspectives of the supervision subject,the supervision object and the supervision process.The third part is the analysis of the causes of the problem.According to the collected data,we rationally and objectively explored the shortcomings of the banking industry in the protection of financial consumer information security and the reasons for this phenomenon.We found that the power of financial regulators in China is decentralized,and the privacy and particularity of financial consumer information security are strong.Although the relevant regulatory departments have paid attention to this problem,However,there are still some difficulties in the actual implementation of supervision and the effect of supervision is not very intuitive.In addition,there is no special laws and regulations for financial consumers in China for the time being,and the relevant legal system is not perfect,resulting in the lack of pertinence of the regulatory basis.The fourth part exemplifies the excellent experience of domestic Hangzhou,Ningbo in the supervision of financial consumer information security protection,and discusses how w City can learn from it.The fifth part puts forward the relevant countermeasures for the optimization of the implementation and supervision of the information security protection policy for financial consumers in the banking industry.This paper believes that first of all,we should improve the legal policy,improve the legal system,improve the executive power of institutions,and further urge financial institutions in the banking industry to build a financial consumer information security protection mechanism covering the whole process before,during and after the event;Secondly,we should strengthen supervision,improve the comprehensive quality and ability of financial institutions,and improve the pertinence of supervision;Finally,we should improve the regulatory environment,enrich complaint channels,and strengthen policy publicity.In addition,we should incorporate information security protection knowledge into the national education system to further consolidate the national self-protection consciousness.
